On 07-17-2022 at approximately 14:52 hours I, A. Maleski W150, responded code 1 to [200 BLOCK] Glen Avenue Apartment [REDACTED] Winder Georgia 30680 in reference to a domestic dispute. Barrow County Dispatch advised me that the caller stated her husband slapped her and left the residence. The caller stated the male was wearing blue shorts and a tie-dye shirt. The caller stated her husband left with a black dog.
Myself and Sergeant Evans check the area for the individual that the caller described. We did not locate anyone in the area.
I made contact with the complainant at the residence. The complainant identified herself as [REDACTED BY AGENCY]. [REDACTED BY AGENCY] stated her husband, who she identified as Benjamin Haney, got into a verbal argument. [REDACTED BY AGENCY] stated things escalated and became physical. [REDACTED BY AGENCY] stated the reason the argument occurred was because she asked Benjamin where he was last night. [REDACTED BY AGENCY] stated Benjamin got mad at her for asking him where he was.
[REDACTED BY AGENCY] stated she was standing in the leaving room when Benjamin approached and slapped her. [REDACTED BY AGENCY] stated Benjamin used his right open hand and slapped her on the left cheek. I observed a red mark on [REDACTED BY AGENCY] left cheek. [REDACTED BY AGENCY] stated she told Benjamin she would call the police.
[REDACTED BY AGENCY] stated while she was calling the police Benjamin left the residence. [REDACTED BY AGENCY] was willing to provide a written statement but stated she would rather have me write it. I advised [REDACTED BY AGENCY] I had the conversation recorded on my body camera. [REDACTED BY AGENCY] was provided with Barrow County Services regarding family violence. Sergeant Evans took pictures of the injuries to [REDACTED BY AGENCY] cheek.
Based on the information I gathered from [REDACTED BY AGENCY] I took warrants for Benjamin’s arrest. I took a warrant for Battery Family Violence due to Benjamin intentionally causing visible bodily harm.

At approximately 17:42 Barrow County Dispatch contacted me stating Benjamin Haney wished to speak to me in reference to an incident that occurred at [200 BLOCK] Glen Avenue Apartment [REDACTED]. I advised Dispatch to connect me through my phone.
I spoke with Benjamin and he advised me he just had an argument with his wife. I asked Benjamin if he was willing to meet with me and provide me with a written statement. Benjamin stated he could meet with me at 247 North Broad Street Winder Georgia 30680 (Red Hot Car Lot).
I traveled to 247 North Broad Street Winder Georgia 30680 and met with Benjamin. Benjamin stated that he and his wife were going through a lot lately. Benjamin stated he came to the house today 07/17/2022 to pick up some of his belongings. Benjamin stated he told his wife ([REDACTED BY AGENCY]) that he wanted a divorce. Benjamin stated his wife was not happy with him. Benjamin stated he gave her a loving touch on her cheek.
I asked Benjamin what did he mean by loving touch. Benjamin stated he just placed an open hand on her cheek. Benjamin stated after he placed an open hand on her cheek she advised him to leave her property. Benjamin stated he grabbed his dog and left the residence. Benjamin was willing to provide a written statement. Winder Police Department Statement Form is attached to this report.
Based on Benjamin’s and [REDACTED BY AGENCY] statements I believe Benjamin is the predominant aggressor in this incident.
I told Benjamin he was under arrest for battery family violence. I placed Benjamin into handcuffs. Benjamin’s handcuffs were checked for proper fit and double locked. I searched Benjamin incident to arrest for weapons, contraband, and means of escape, but nothing was located. Benjamin was placed in the rear of my marked patrol vehicle #396 and secured with a seatbelt.
I transported Benjamin to Barrow County Detention Center. I relinquished custody of Benjamin to Barrow County Intake Deputies without incident. The back seat of my patrol vehicle #395 was checked for contraband before and after transporting Benjamin. Nothing was located.
The Victim Notification form was completed and left at Barrow County Detention Center and attached to this report.
