On 05/06/2023 at 2109 hours, Ofc. Waters and I (Sgt. Wolfe) were dispatched to the Ichiban Buffet Restaurant located at 78 E. May Street, Winder, GA in reference to a suspicious Activity call. Dispatch advised there was a male on the scene that had entered the women’s restroom and had urinated all over the place including on the caller. Dispatch also advised that the male was still on the scene.

Upon my arrival, code 1, I met with [VICTIM #1], [VICTIM #2] and [VICTIM #3]. All stated that they were inside the women’s restroom when a Hispanic male barged in. They stated that the male had his pen*s out of his pants and was urinating everywhere. They stated that they began yelling and screaming at the male and began trying to push him out of the restroom. They stated that during the incident the male was urinating all over the restroom floor, the walls, and the doors of the stalls. They also claimed during the incident while they were pushing him out of the restroom that he had urinated on their feet. They stated that they pushed the male out of the restroom he continued urinating in front of the door and in the hallway before going inside the men’s restroom.

While speaking with the group, a Hispanic male emerged from the restaurant’s front doors. They all stated that was the male that entered the restroom. Ofc. Waters and I then placed the male, later identified as Chrisobal Lopez Vasquez, into handcuffs behind his back. They were double-locked and checked for proper spacing. Mr. Vasquez had extremely bloodshot eyes and had a strong odor of an alcoholic beverage emitting from his person. The male also smelled of urine and had a clearly visible wet large wet spot on his jeans, starting from his groin area and going all the way down his leg. We asked for his name, and he claimed that he did not speak English. I also observed a strong odor of an alcoholic beverage emitting from his person when he spoke.

He was escorted to Ofc. Waters’ patrol car where he was placed into the back seat and seat belted in. Mr. Vasquez continued to deny speaking any English and was not cooperative with Ofc. Waters as he tried to obtain information and talk with Mr. Vasquez about the incident.

We returned and began to speak with the group again about what happened. Ms. [VICTIM #1] and Ms. [VICTIM #3] both stated that their young daughters were present inside the restroom with them when Mr. Vasquez came in but both stated that their daughters did not witness Mr. Vasquez’s pen*s or got urinated on as they shielded them in the stall. Mrs. [VICTIM #1], Mrs. [VICTIM #2], and Mrs. [VICTIM #3] completed written statements on the incident, and they will be attached to this report. All three wished for criminal charges to be brought against Mr. Vasquez for this incident.

The general manager of Ichiban did not wish for Mr. Vasquez to be criminally trespassed from the restaurant.

Ofc. Waters then transported Mr. Vasquez to the Barrow County Detention Center without incident.

I then obtained the following warrants against Mr. Vasquez in this case;

OCGA 16-6-8 Public Indecency x3 (2023-1547MW/ 2023-1548MW/ 2023-1549MW)
OCGA 16-11-41 Public Drunkenness (2023-1550MW)
OCGA 16-11-39 Disorderly Conduct (2023-1551MW)

I spoke with the judge about possibly obtaining two counts of cruelty to children against Mr. Vasquez but was advised due to the children not witnessing Mr. Vasquez’s sexual organ or being urinated on that it does not fit the statute.

The back seat of Ofc. Waters patrol car was checked prior to and after Mr. Vasquez was placed inside.
