Synopsis

On 04/04/2022 at approximately 1313 hours, I conducted a traffic stop on Atlanta Hwy NW at Business Center Dr on the suspect vehicle, a white 1998 Toyota Camry bearing Georgia registration [REDACTED]. An investigation identified Mr. George Pickett as the suspect in this case.

Probable cause supported charges for driving while license suspended OCGA 40-5-121 and safety belt violation OCGA 40-8-76.1 in that George was operating the suspect vehicle while his driver’s license was suspended for failure to appear as of 08/02/2021 and he was not utilizing any form of safety belt.

Initial Contact and Observations

I observed the suspect vehicle traveling east in front of me on Bankhead Hwy toward Bankhead Hwy Conn. I closed distance with the vehicle and noticed the driver was not utilizing any form of safety restraint in violation of OCGA 40-8-76.1. An NCIC check of the license plate attached to the vehicle identified Mr. George Pickett as the registered owner of the vehicle.

The NCIC check revealed George’s driver’s license was suspended for failure to appear as of 08/02/2021. I observed the driver look into his driver side rear view mirror and noticed the driver matched the DDS photo of George. At that time, I initiated a traffic stop on the vehicle on Atlanta Hwy NW at Business Center Dr.

I approached the vehicle on the driver side and noticed two occupants inside the vehicle. I confirmed George was the driver of the vehicle. I asked him for his driver’s license, and he told me he did not have it with him. I asked him why he did not have his driver’s license. He told me his driver’s license was suspended.

I asked him why he was driving. He told me he was going to the store to fix a tool and knew he should not be driving. I spoke with the passenger and asked him if he had a valid driver’s license. He told me he did not. The passenger identified himself as Mr. [WITNESS #1]. I advised George to call someone to secure his vehicle. At that time, I returned to my patrol vehicle.

Further Investigation

A local history check of George and the suspect vehicle revealed he was stopped by Lt. Witte S-33 on 02/20/2022 where he was arrested for driving while license suspended, safety belt violation, and speeding. Reference case number 2022-00011229.

Action Taken

I returned to George and instructed him to exit the vehicle to which he complied. I placed George in handcuffs behind his back that I checked for fit and double locked. He asked me if he was under arrest. I told him he was. I secured George in the rear of my patrol vehicle at which time he began breathing quickly and heavily. I asked George if he was okay. He told me he was not, and he needed his inhaler. He told me it was in the car and [WITNESS #1] could find it.

[WITNESS #1] provided the inhaler at which time I uncuffed one of George’s hands to facilitate the proper use of his inhaler. He used the inhaler and told me he was okay. He further advised the handcuffs were hurting his shoulders. I placed George in two pairs of handcuffs behind his back. I checked both pairs of handcuffs for proper fit and double locked them.

I asked George who was coming to secure his vehicle. He told me Ms. [WITNESS #2] was coming to secure his vehicle, but she would be walking to the scene from Creekwood Rd. Deputy Cruz S-145 spoke with [WITNESS #2] via telephone and offered to pick her up from Creekwood Rd. Deputy Cruz provided [WITNESS #2] with transport and [WITNESS #2] took possession of the vehicle at George’s request. [WITNESS #2] provided a valid driver’s license.

I transported George to Barrow County Detention Center where he was lodged on citations for driving while license suspended OCGA 40-5-121 #134626 and safety belt violation OCGA 40-8-76.1 #134627. The rear of my patrol vehicle was checked before and after transport and no contraband was located.
