Officer’s Narrative:

On Thursday December 22, 2022, at approximately 0052 hours, I was dispatched to [REDACTED BY AGENCY] Winder, GA 30680, in reference to a domestic dispute that sounded physical at the time of the call according to Dispatch. Dispatch did not have an actual address for the call that came out. Dispatch advised they could hear someone in the back ground struggling to breathe. We were dispatched to a general location of where the call came from at the time of the incident. While we were enroute to the call, dispatched advised that it would be the third building back from the entrance on 2nd Street. An exact location was still unknown, and no apartment number was known.

Officer Perrin went in The Flats apartments located at [REDACTED BY AGENCY] Winder, GA 30680 after the description from Dispatch. Officer Perrin went to the third building and listened to all of the doors to see if he could hear a dispute in progress. Officer Perrin could hear loud yelling coming from apartment [REDACTED BY AGENCY] located at the [REDACTED BY AGENCY] apartments. This apartment was in fact where the victim had called from about the dispute. I responded to the call CODE 1 due to nature of not having a exact location of where the dispute was coming from.

Upon arrival to the apartments, Officer Perrin could hear yelling coming from apartment [REDACTED BY AGENCY]. Officer Perrin directed Mr. Matthew Faulkner out of the residence along with Mr. Jordan Harris. Mr. Faulkner came down the stairs at the front of the apartment and talked with me about the situation. Mr. Harris stayed at the top of the stairs with Officer Davis. Officer Perrin went into the residence to make contact and talk with [REDACTED BY AGENCY].

Mr. Faulkner told me his side of the story. Mr. Faulkner stated that all three of the men went out drinking for the night to have some fun. Then they all came back to the apartment, [REDACTED BY AGENCY] Winder, GA 30680. Mr. Harris and Mr. Faulkner are best friends. The apartment is rented by Mr. Faulkner and [REDACTED BY AGENCY] who are in a relationship. Mr. Faulkner said that once they had returned to the apartment he went to [REDACTED BY AGENCY] and began to tell him about his feelings. Mr. Faulkner told [REDACTED BY AGENCY] that he felt he was not getting shown any affection and wanted more to be shown by [REDACTED BY AGENCY]. Mr. Faulkner stated that is when things started to turn into an argument, but nothing physical ever happened.

Mr. Faulkner said he and [REDACTED BY AGENCY] got into a heated argument and that [REDACTED BY AGENCY] wanted to leave the apartment. Mr. Faulkner said that he did not want [REDACTED BY AGENCY] to leave and was trying to get him to stay but that just escalated the argument. Mr. Faulkner assured that nothing physical happened between him and [REDACTED BY AGENCY]. Mr. Faulkner advised only a loud argument had occurred. I have a written statement from Mr. Faulkner about the situation. Corporal Hill stayed with Mr. Faulkner while I interviewed the other parties involved.

After speaking with Mr. Faulkner, I went to the top of the stairs and talked with Mr. Harris. Mr. Harris stated that all three men went out drinking and then came back to the apartment after a night of drinking. Mr. Harris said that Mr. Faulkner and [REDACTED BY AGENCY] were talking and then he heard a bang in the bedroom. Mr. Harris said he then went into the bedroom and [REDACTED BY AGENCY] was throwing stuff at Mr. Faulkner and they were arguing loudly. Mr. Harris advised that some physical touching happened, but that it was more like grabbing each other and shoving back and forth between Mr. Faulkner and [REDACTED BY AGENCY]. Mr. Harris stated that he was just trying his best to separate both parties and keep things from getting any worse than they already were before we arrived on scene.

Mr. Harris said things would have gotten a lot more physical if we did not show up to the apartment. Mr. Harris advised he was the middle person just trying to keep Mr. Faulkner and [REDACTED BY AGENCY] away from each other. I have a written statement from Mr. Harris about the situation.

I then went inside the apartment to talk with [REDACTED BY AGENCY] about the situation. [REDACTED BY AGENCY] stated that all three men had went out for Mr. Faulkner’s birthday. They all then came back to the apartment after grabbing drinks. [REDACTED BY AGENCY] stated that he was heating up some pizza and was trying to give some of the pizza to Mr. Faulkner. [REDACTED BY AGENCY] did advise he burnt the pizza a little bit, but was still trying to give it to Mr. Faulkner because he was drunk and needed food. [REDACTED BY AGENCY] said that doing that made Mr. Faulkner mad.

[REDACTED BY AGENCY] then told me that all three men were in the bedroom laying in the bed. [REDACTED BY AGENCY] was holding a cigarette in one hand and an ashtray in the other hand. This is when Mr. Faulkner asked [REDACTED BY AGENCY] why he does not touch him anymore and wanted [REDACTED BY AGENCY] to put his arm around him.

[REDACTED BY AGENCY] told Mr. Faulkner he couldn’t because he was holding the cigarette and the ashtray. [REDACTED BY AGENCY] said that he did not want Mr. Faulkner putting cigarette ash in the bed and that is why he was holding the ashtray. [REDACTED BY AGENCY] stated that this made Mr. Faulkner even more mad. [REDACTED BY AGENCY] then wanted to leave the apartment because he knew things were going get bad if he stayed at the apartment. [REDACTED BY AGENCY] stated he then got up and wen to the living room to get his things and began packing a bag to leave. [REDACTED BY AGENCY] said Mr. Faulkner was not letting him gather his belongings and leave the apartment.

All the couple was doing was arguing and [REDACTED BY AGENCY] just wanted to leave. [REDACTED BY AGENCY] then called 911 so that he would be able to leave. When [REDACTED BY AGENCY] called 911, [REDACTED BY AGENCY] stated both Mr. Faulkner and Mr. Harris threw him on the ground getting the phone out of his hands and began to strangle him. [REDACTED BY AGENCY] said he could barely breathe and was just trying to leave. [REDACTED BY AGENCY] also stated Mr. Faulkner and Mr. Harris ripped his shirt off then both men got on top of him strangling him as he was on the phone with 911. [REDACTED BY AGENCY] stated that it was both Mr. Faulkner and Mr. Harris on top of him and fighting him, not just one of them. A written statement was taken by [REDACTED BY AGENCY] about the situation.

[REDACTED BY AGENCY] had very visible marks all over his chest and all around his neck. I observed the ripped t-shirt on the floor just outside of the bedroom. [REDACTED BY AGENCY] said that his shirt was ripped off of him in the middle of Mr. Faulkner and Mr. Harris wrestling him to the ground. I viewed the white t-shirt ripped into two separate pieces on the ground. The collar part of the shirt was separated from the rest of the shirt. All of the marks showed signs of strangulation. Marks were located on the hands and wrists of both Mr. Faulkner and Mr. Harris. The marks on the wrist of both Mr. Faulkner and Mr. Harris looked like someone was trying to grab their wrist and get them from off/around from themselves. Photos of all the marks were taken and attached to this report.

After my investigation and present evidence at the scene of the dispute, I had four separate charges to take on Mr. Faulkner and [HARRIS] who were both deemed as predominant aggressors. Mr. Faulkner was placed under arrest. Mr. Faulkner was placed into double locked hand cuffs and checked for proper fit. Mr. Faulkner was then searched incident to on site arrest for any weapons, contraband, or means of escape, none were found. Mr. Faulkner was then placed into the searched back seat of my marked patrol vehicle and seat belted in the back seat.

Mr. Harris was then placed into double locked handcuffs and checked for proper fit by Officer Perrin. Officer Perrin then searched Mr. Harris for weapons, contraband, or means of escape, none were found. Mr. Harris was then placed into the searched back seat of Officer Perrin’s marked patrol vehicle and seat belted in the back seat. Both Mr. Faulkner and Mr. Harris were transported to the Barrow County Detention Center and turned over to Barrow County Jail Deputies.

They confined [REDACTED BY AGENCY] to the apartment and would not allow him to leave his own residence.

2022-3875FW: Mr. Harris was charged with False Imprisonment because Mr. Faulkner and Mr. Harris kept [REDACTED BY AGENCY] from leaving the house by taking him to the ground after [REDACTED BY AGENCY] said that he wanted to leave the house. They confined [REDACTED BY AGENCY] to the apartment and would not allow him to leave his own residence.

2022-3880MW: Mr. Faulkner was charged with Hindering a 911 call charges because the moment Mr. [REDACTED] tried to call 911 he was taken to the ground by Mr. Faulkner and Mr. Harris. The phone was taken out of his hands during the call to 911 and dispatched advised they could hear yelling and a man struggling to breathe during the phone call.

2022-3876MW: Mr. Harris was charged with Hindering a 911 call charges because the moment [REDACTED BY AGENCY] tried to call 911 he was taken to the ground by Mr. Faulkner and Mr. Harris. The phone was taken out of his hands during the call to 911 and dispatched advised they could hear yelling and a man struggling to breathe during the phone call.

2022-3881MW: Mr. Faulkner is charged with Criminal Trespass charges Family Violence because he and [REDACTED BY AGENCY] are currently roommates at the apartment they are renting and both on the signed lease for the apartment. The shirt was ripped off and torn into two separate pieces on the ground of the bedroom doorway.

2022-3877MW: Mr. Harris is charged with Criminal Trespass charges because the shirt [REDACTED BY AGENCY] was wearing was ripped off of his person and thrown on the ground. The shirt was in two separate pieces on the floor at the entrance of the bedroom.

[REDACTED BY AGENCY] was given resources for domestic violence and phone number for help with situations like the one he was involved in. He was also given my business card with the case number.

Watch Guard body camera was worn and activated during this investigation.

Both vehicles were check for weapons, contraband, and drugs before and after transport to Barrow County Detention Center with negative results.
