On Wednesday, February 8, 2023, at 1544 hours, I was dispatched to the area of Highway 20 and Rose Brooke Circle White, GA 30184 in reference to a domestic incident that occurred at 35 Carson Loop Cartersville, GA 30121.
On arrival, I spoke to [VICTIM #1] who advised she has been having issues with her boyfriend David Mackendrick who has been physical with her since Sunday, February 5, 2023. [VICTIM #1] stated that David slapped and punched her eye leaving bruises as well as a cut eyebrow. He continued being aggressive and violent with her on Monday, Tuesday, and today. She stated she could not ask for help due to David tying her hands inside the hotel room as he prevented her from going outside. [VICTIM #1] communicated to me she did not have phone access to call 911 when the incident first occurred. [VICTIM #1] stated each day up until today, he would punch, push, and choke her. She advised she lost consciousness a few times when he choked her throughout the incident dates.
I informed [VICTIM #1] if she wanted an ambulance to check her out and she advised no. As I was speaking to her she advised she had difficulty speaking and swallowing due to the constant pressure David would apply to her throat. I observed her left eye was bruised, left eyebrow cut open with dried blood. Under her chin at the throat she had bruising from where she was strangled. Also her wrists had bruising and I could see where her hands were tied with a rope.
[VICTIM #1] then informed me that on today’s date at approximately 0700 hours at the location of 873 Cassville White RD Cartersville, GA 30121, she went to the Chevron with David and he began being physical with her outside. She stated several clients saw the altercation and at this point, [VICTIM #1] noticed an opportunity to escape from David. She went back to the hotel room ([REDACTED]) and locked herself inside before David arrived. David arrived shortly after and began knocking on the door advising [VICTIM #1] to let him in. She opened the door to give David his wallet and he rushed inside the room in an attempted to close the door with [VICTIM #1] inside, however, she exited the room and a neighbor took her inside their room. [VICTIM #1] called someone to pick her up from this location and called 911 to make a report.
I asked [VICTIM #1] if she was willing to fill out a voluntary statement and she advised yes. After observing her voluntary statement and listening to her verbal statement, it was determined her account of events were consistent, therefore, I attempted to locate David at 35 Carson Loop room [REDACTED]. I arrived and knocked on room [REDACTED] and made contact with David. I advised him he was under arrest and explained the reason he was being arrested. As I applied handcuffs I double locked them to check for fit and searched him incident to arrest. Before he had the chance to say something I read him Miranda warning and he indicated he did not want to speak to me.
I transported David to the Bartow County jail and released him to staff without incident. Based on the evidence and having enough probable cause, I proceeded to secure arrest warrants on David for aggravated assault (family violence), battery (family violence), and false imprisonment (family violence). The related charges are family violence due to [VICTIM #1] and David currently living together for the past several months and being members of the same household.
Photos of [VICTIM #1]’s injuries were taken on my body-worn camera. I provided her with a case number and information pertaining to the victim’s assistance program.
