Officer’s Narrative:

On Wednesday, June 15, 2022, while patrolling the area of South Tennessee Street and West Avenue, I observed a black Mitsubishi Mirage bearing Georgia tag [REDACTED]. I observed the vehicle leave the Texaco gas station at 240 S. Tennessee Street.

When I got behind the vehicle I observed the driver, later identified as Sean Grooms turn left on West Avenue. The vehicle turned into the IMP Fuels gas station at 301 South Erwin Street and immediately exited the parking lot turning right onto South Erwin Street.

The vehicle accelerated at a high rate of speed and turned right onto Justice Robert Benham Drive failing to yield at the yield sign when turning. The vehicle again accelerated at a high rate of speed before turning left onto Old Mill Road traveling to the area of where I first saw the vehicle. At this point, I conducted a traffic stop on the vehicle.

I made contact with the driver, Mr. Grooms, and the front seat passenger, Haley Schmick. Both occupants were ran through GCIC which revealed Mr. Grooms was on active felony probation. I asked Mr. Grooms to exit the vehicle to which he complied. Mr. Grooms admitted he was on probation for a possession charge.

Mr. Grooms stated there was not any illegal contraband inside the vehicle, and consented to a search of the vehicle and his person. There was no illegal contraband located on Mr. Grooms’ person. I asked Ms. Schmick to exit the vehicle to which she complied. When Ms. Schmick exited the vehicle, I noticed a bulge in her left pant leg.

When asked what it was, Ms. Schmick stated it was a gun. I placed Ms. Schmick into handcuffs to the rear, checked for fit, and double locked. Sgt. Hichez placed Mr. Grooms into handcuffs to the rear, checked for proper fit, and double locked. I retrieved a Jimenez Arms 9mm from her pant leg.

I cleared the firearm and emptied the full magazine that was in it. Ms. Schmick admitted to having more contraband on her, and stated there was a bag inside her jacket sitting under the zipper on top of the lining in the jacket. I retrieved a plastic bag containing a suspected methamphetamine pipe, a torch lighter, and empty, unused plastic bags. No other contraband was located on Ms. Schmick’s person.

I conducted a search of the vehicle for additional contraband. In the driver’s side floor board under a purple Crown Royal Bag, I located another magazine for a firearm with bullets in it. No other contraband was located inside the vehicle.

At this point, I read Ms. Schmick her Miranda Rights. Ms. Schmick stated she understood her rights and agree to speak to me without legal counsel present. Ms. Schmick stated she and Mr. Grooms were at the gas station on South Tennessee Street. Once I got behind the vehicle on West Avenue, Ms. Schmick stated Mr. Grooms became nervous and gave her the gun and bag containing the paraphernalia.

Ms. Schmick admitted she has recently used methamphetamine and has only been hanging out with Mr. Grooms the last couple of days. The interview with Ms. Schmick was audio and video recorded.

I read Mr. Grooms his Miranda Rights. Mr. Grooms stated he understood his rights and agreed to speak to me without legal counsel present. Mr. Grooms denied knowing about anything illegal and stated he believed Ms. Schmick got the gun from somewhere on Cedar Creek Road.

Mr. Grooms and Ms. Schmick were transported to the Bartow County Jail by Officer Starnes. The rear seat of Officer Starnes’ patrol vehicle was searched for contraband before and after transport for contraband with none located. The Mitsubishi Mirage was towed by Boyd Martins.

Once at the jail, Mr. Grooms and Ms. Schmick consented to a search of their urine. Both signed a consent to search form. A preliminary urine test result on each subject was positive for Methamphetamine. Warrants were obtained for Mr. Grooms for Possession of Methamphetamine, Possession of Methamphetamine by Ingestion, Possession of a Firearm by A Convicted Felon, Possession of A Firearm During the Commission of a Felony, and Drug Related Objects.

Warrants were taken for Ms. Schmick for Possession of Methamphetamine, Possession of Methamphetamine by Ingestion, Possession of A Firearm During the Commission of a Felony, and Drug Related Objects. The glass pipe, empty bags, firearm, ammunition, consent to search forms, and extra magazine were placed into evidence at the Cartersville Police Department.

Copies of the warrants were scanned into the case file along with the consent forms. Nothing further.
