Officer’s Narrative:

On Wednesday, February 8th, 2023, at approximately 1251 hours, I was dispatched to 317 East Church Street (Capri), in reference to a female that appeared to be “shaken up” and possibly involved in a domestic.

Upon arrival I made contact with the employees who called in on the female Mr. [WITNESS #1] and Ms. [WITNESS #2]. Ms. [WITNESS #2] stated that a female came into the restaurant with red marks on her hands and that she seemed distraught. Ms. [WITNESS #2] stated that there was a male who entered into the restaurant with her. The employees were concerned that they she had possibly been involved in a domestic violence situation with the male.

Mr. [WITNESS #1] provided me with the tag number [REDACTED], that he obtained off of the vehicle they had left in. Ms. [WITNESS #2] showed me the receipt where they had paid for the food. The receipt showed that the name on the card used was Jessica Maybern, but a male signed the receipt for her with his name of Robert Roland. The tag number provided to me returned with Mr. Roland to be the registered owner. Both subjects were ran through locals and returned be known offenders of narcotics.

I looked up local addresses’s for Mr. Roland and found two addresses’s in the area of Atco. I called out over the radio the tag number provided, both names provided, and what was going on. I called out over the radio that I was en rout to the area of Atco to attempt to locate the suspect vehicle in order to check welfare on Ms. Maybern. Officer Mcarthur heard this radio traffic and also responded to the area to attempt to locate the suspect vehicle. Officer Mcarthur located the suspect vehicle parked at the gas pumps of 263 Cassville Road (BP), with Ms. Maybern in the passenger seat.

Upon my arrival I spoke with Ms. Maybern, who was visibly shaking all over. Ms. Maybern had pinpoint pupils and was difficult to understand. Ms. Maybern had red hand, and obvious bruising from injection marks/track marks in the crease of her arms, lined up with her visible veins. From my experience it was immediately apparent to me that Ms. Maybern was under the influence of Narcotics. Ms. Maybern stated to me that no Domestic situation had occurred between her and Mr. Roland on this date. Ms. Maybern stated to Officer Mcarthur that Mr. Roland was inside of BP.

Officer Mcarthur located Mr. Roland inside BP. Mr. Roland stated to Officer Mcarthur that he was the driver of the suspect vehicle. Mr. Roland stated that no domestic violence situation had occurred between him and Ms. Maybern on this date. After determining that no domestic violence crime had occurred I asked Mr. Roland about Ms. Maybern’s condition. Mr. Roland stated that Ms. Maybern was a user of narcotics and was trying to get clean.

Ms. Maybern was asked consent to search her belongings inside the vehicle, and she declined. Mr. Roland was asked for consent to search the vehicle, and he also refused. Deputy Robinson responded to scene with his K-9 Cairo. Deputy Robinson deployed canine Cairo to conduct a free air sniff of the vehicle. Following the deployment, Robinson advised Cairo did give a positive alert to the vehicle indicating the presence of the odor of narcotics being emitted from the vehicle.

Inside the suspect vehicle in the drivers side door above the handle, I observed a Marlboro cigarette pack. Inside the cigarette pack, I located a clear plastic bag with a folded piece of white paper inside. Inside the folded piece of paper I observed a purple powdery substance. Underneath the cigarette pack was another piece of paper that had 3.5 blue pills inside. Underneath that piece of paper was 5 more white pills and another blue pill. The white pills marked M 15 were identified as Atropine Sulfate and Diphenoxylate Hydrochloride, which is a Schedule 5 controlled substance, and the blue pills marked GG 258 were identified as Alprazolam which is a Schedule 4 controlled substance.

The pills were identified using Drugs.Com. I observed a syringe on the center console between the driver and passenger seat. Officer Starnes located syringes in a pink zipper pouch located where Ms. Maybern was sitting. Officers Starnes also located Narcan inside the center console. Officer Starnes located a black wallet inside the purse located around the drivers seat, inside the wallet was Ms. Mayberns drivers license, along with a blue pill marked R 031. The pill was identified as Alprazolam which is a Schedule 4 controlled substance.

Ms. Maybern and Mr. Roland were placed under arrest by handcuffs behind the back. Handcuffs were checked for fit and double locked for safety. DTF Agents Sgt. Cole and Lt. Firth responded to scene. Agent Cole read Mr. Roland and Ms. Maybern Miranda rights and questioned them about the drugs located inside the vehicle. Agent Cole stated that Mr. Roland stated that the purple powdery substance located inside the vehicle was Fentanyl and that it belonged to him.

Further details from Agent Coles questioning can be found in a supplemental to this report. Fentanyl is a Schedule 2 controlled substance. The suspected Fentanyl and the pills were collected to be submitted to the GBI for additional testing. The suspect vehicle was turned over to Ms. [REDACTED] on scene. Officer Mcarthur transported Ms. Maybern and Mr. Roland to Bartow County Jail, where they were left in their custody.

Warrants were obtained for Ms. Maybern and Mr. Roland for Possession of a Sch 4 Controlled Substance, Possession of a Sch 5 Controlled Substance, Possession of a Sch 2 Controlled Substance, Possession of Drug Related Objects, and Drugs To Be Kept In Original Container.
