[NARRATIVE #1 on June 22, 2022]

On Wednesday, June 22, 2022, at approximately 1842 hours, I was dispatched to 100 Gentilly Blvd, Home Depot, in reference to a shoplifting in progress. While en route to the scene, I was advised that Home Depot had called back stating that someone else had just walked out with merchandise.

Upon arrival, I met with Mr. [WITNESS #1], a employee of Home Depot, who stated that a white male tried to walk out of the business with about $988 worth of merchandise. Mr. [WITNESS #1] stated that the male came into the business around 1830 hours and left around 1842 hours. Mr. [WITNESS #1] stated that he watched the male walk to the doors to leave with a shopping cart of items. Mr. [WITNESS #1] stated that he was able to catch the male before he walked out of the door and grab the shopping cart. Mr. [WITNESS #1] stated that the male ran into the parking lot and got into a gray Chevrolet Equinox. Mr. [WITNESS #1] stated that he was unable to get the license plate from the vehicle.

Mr. [WITNESS #1] stated the male attempted to take a 6K BTU window AC, valued at $239; a WYZE Cam Pan V2, valued at $49.98; a 20L Surge + Wireless Charger & USB, valued at $32.88; a Ventev 14 inch Lightening Helix Cable, valued at $25.99; a 10,000 MAh Slim Pocket Juice, valued at $22.97; a Dewalt FV 60V 4 1/2-6 Grinder Kit, valued at $339; and a Dewalt 21 Degree Framing Nailer, valued at $279.

Mr. [WITNESS #1] stated that Home Depot wished to press charges. Mr. [WITNESS #1] was able to provide video surveillance of the male in the business. The male is seen wearing a red shirt, black Carhartt hat and have full sleeve tattoos on both arms. The still photos obtained from Mr. [WITNESS #1] of the male were attached to the case file. Home Depot was advised of their rights as a victim.

[NARRATIVE #2 on June 22, 2022]

On Wednesday, June 22, 2022, at approximately 1842 hours, I was dispatched to 100 Gentilly Blvd, Home Depot, in reference to a theft in progress, reference case 2022-10493. While en route to the scene, I was advised that Home Depot called and stated that someone else had taken items from the business.

Upon arrival, I met with Ms. [WITNESS #2], a Home Depot employee, who stated that a white male, later identified as Mr. Timothy Kennedy, and a white female, had taken approximately $766 of merchandise. Ms. [WITNESS #2] stated that Mr. Kennedy and the female came into the business around 1854 hours and left with the items around 1908 hours.

Ms. [WITNESS #2] stated that she was unable to get to Mr. Kennedy and the female before they left the business without paying. Ms. [WITNESS #2] stated that she saw Mr. Kennedy and the female get into a red 1998 Ford Explorer bearing GA license plate [REDACTED] and drive off with the items.

Ms. [WITNESS #2] stated that Mr. Kennedy and the female left with a M12 Fuel 4.0/2.0 OAH HAMD/Impact Kit, valued at $179; 2 RYB One+ HP BL Hammerdrill & Impact, valued at $229 each; and a RYB One+ 4.0AH Premium Starter Kit, valued at $129.

Ms. [WITNESS #2] stated that Home Depot wished to press charges. Ms. [WITNESS #2] was able to provide video surveillance of Mr. Kennedy and the female inside the business. Still photos were attached to the case file. Mr. Kennedy was seen wearing a gray sleeveless shirt and blue jeans. The female was seen wearing a light blue shirt and black shorts.

Officers were able to contact the registered owner of the vehicle, Ms. [REDACTED], via phone. Ms. [REDACTED] stated that her son, Mr. Kennedy was driving the vehicle and she did not know who the female was. Ms. [REDACTED] stated that she did not know where Mr. Kennedy could be going or was living.

Warrants were obtained for Mr. Kennedy for theft by shoplifting(F). A copy of the warrant was scanned into the case file. Ms. [WITNESS #2] was advised of the rights that Home Depot has as a victim.

[NARRATIVE #3 on June 22, 2022]

On Wednesday, June 22, 2022, at approximately 2348 hours, Bartow County Sheriff’s Deputies located the suspect vehicle in this case, 1998 red Ford Explorer bearing GA license plate [REDACTED], at 501 N Tennessee Street, Circle K. Upon making contact with the driver, Ms. Ashley Amos, and passenger, Mr. Frederick Dodson, I observed a package in the rear of the vehicle. The unopened package resembled a RYB One+ 4.0AH Premium Starter Kit that was taken from Home Depot in the original case.

Ms. Amos was placed into handcuffs to the rear. The handcuffs were checked for fit and double locked. Ms. Amos was searched incident to arrest with no contraband located. Mr. Dodson was placed into handcuffs to the rear. The handcuffs were checked for fit and double locked. Mr. Dodson was searched incident to arrest where a small clear wrapper, appearing to be a wrapper from a pack of cigarettes, containing 5 round orange pills with the markings “970” on them. Mr. Dodson stated that the pills were Suboxone.

A search of the vehicle yielded a RYB One+ 4.0AH Premium Starter Kit, new in the package. None of the other tools were found in the vehicle. No other contraband was located either.

Ms. Amos stated that Mr. Kennedy was with her but left walking on foot before officers arrived and she did not know where he went. I explained to Ms. Amos and Mr. Dodson that the item that I located in the vehicle had been stolen from Home Depot earlier this date by Mr. Kennedy.

Both Ms. Amos and Mr. Dodson stated that they did not know that the item was stolen or that it was even in the vehicle. A GCIC check of Ms. Amos’ name and date of birth, yielded that she had an active warrant through Bartow County Sheriff’s Office for probation violation on the original charge of driving while license suspended. Cartersville Dispatch conformed the warrant.

Ms. Amos and Mr. Dodson were transported to Bartow County Jail Without incident. My issued marked patrol vehicle was checked at the start of shift, before and after each transport, with no contraband located. A warrant was secured for Ms. Amos for theft by receiving. A warrant was secured for Mr. Dodson for theft by receiving. Copies of the warrants were scanned into to the case file.

The recovered property was returned to Home Depot.

The incident was captured on my department issued body worn camera and in car dash camera.

[NARRATIVE #4 on June 29, 2022]

On Tuesday, June 29, 2022, at approximately 1510 hours, I was in the area of Felton Road at Felton Place when I observed a blue 2002 BMW 325 (GA tag # [REDACTED]) driving towards N Tennessee Street, being driven by Timothy Kennedy with front seat passenger Kerstin Oldham. Mr. Kennedy and Ms. Oldham had active Theft by Shoplifting – Felony warrants associated with this case.

I caught up to the vehicle and activated my emergency equipment, conducting a traffic stop on the vehicle on Highway 20 at Highway 411. Inv. D.W. Herron was present with me and assisted during the stop. I made contact with Mr. Kennedy and asked him for his driver’s license. Mr. Kennedy stepped out of the vehicle where I placed him under arrest in handcuffs behind his back. The handcuffs were checked for fit and double locked. Inv. Herron made contact with Ms. Oldham and asked her to step out of the vehicle. Inv. Herron placed Ms. Oldham under arrest in handcuffs behind her back. The handcuffs were checked for proper fit and double locked. Mr. Kennedy and Ms. Oldham were searched incident to arrest with no contraband located on their person.

A search of the vehicle in accordance with both of their felony probation statuses was conducted, with no contraband or stolen items recovered.

Mr. Kennedy and Ms. Oldham’s warrants for this case were confirmed by Cartersville Dispatch. I attempted to interview Mr. Kennedy and Ms. Oldham regarding the Home Depot shoplifting, but both parties refused to speak with me. Mr. Kennedy’s BMW was towed by Bulldog Towing.

Inv. Herron and I transported Mr. Kennedy and Ms. Oldham to the Bartow County Sheriff’s Office without incident. The transport vehicle was searched before and after transport with no contraband found.

This case is cleared by arrest.
