On September 5th, 2022, at approximately 2254 hours, I, Officer Prescott, responded to [200 BLOCK] Raleigh Way in reference to a domestic dispute in progress. While en route, dispatch advised the offender had left the scene, returned, and then left again. Upon my arrival, Officer Gordy was already on scene speaking with the complainant, [WITNESS #1]. [WITNESS #1] advised her son, Gerald Johnson, came home from driving for Lyft. Gerald resides in Covington, but has been staying at [WITNESS #1]’s residence on and off over the past two weeks.
[WITNESS #1] was talking with Gerald, and he said he was going to talk to his sister, [VICTIM #1], about helping around the house due to [WITNESS #1] losing her job today. She advised she made Gerald something to eat, and he left her bedroom. She then heard her daughter, [VICTIM #1], screaming. She went in [VICTIM #1]’s bedroom and saw blood on the floor. [WITNESS #1] advised she asked what happened and Gerald then broke [VICTIM #1]’s LG television and Xbox One gaming console. They were still “tussling” as [WITNESS #1] tried to break him away from [VICTIM #1].
At that point, Gerald grabbed [VICTIM #1] around the neck in a choking manner and they started fighting again. He grabbed the damaged television, Xbox One console, and [VICTIM #1]’s phone. He then left the scene. A few minutes later, Gerald returned to the scene and [WITNESS #1] asked him for [VICTIM #1]’s phone. He returned it, asked for his phone, took his clothes, and left the scene again. [WITNESS #1] advised she had Gerald’s phone, which I observed to be laying on [WITNESS #1]’s bed.
I met with the victim, [VICTIM #1], who advised her brother, Gerald, walked into her room to talk to her. He was talking to her about helping out around the house, and telling [VICTIM #1] to “quit school” to support their mother. Gerald then told [VICTIM #1] “he’s not like their other siblings” and told [VICTIM #1] he would break all of her stuff right now. [VICTIM #1] advised Gerald proceeded to break her LG television and her Xbox One gaming console, both valued at approximately $550.00 total. That was when [VICTIM #1] started yelling at Gerald to get out of her room.
He then started to take her television and phone. She tried to stop him and get her phone back. This resulted in a heated argument and that was when Gerald laid his hands on her. [VICTIM #1] advised Gerald choked her and head-butted her nose. She tried to defend herself by hitting him a couple times in his face to get him off her. She advised her nose was bleeding the whole time and she ended up hurting her hand. [VICTIM #1] informed me Gerald took the damaged items and her phone with him when he left the residence.
I met with [WITNESS #1]’s juvenile daughter, [WITNESS #2], who lives at the residence. I asked [WITNESS #2] about what had happened. [WITNESS #2] advised she did not witness Gerald and [VICTIM #1] fighting, but she heard [VICTIM #1] screaming and witnessed their mother, [WITNESS #1], trying to pull Gerald off of [VICTIM #1].
I observed bloody tissues on [VICTIM #1]’s bedroom floor, and more bloody tissues inside of an open trash bag located outside. I observed [VICTIM #1]’s nose to be bleeding and swollen. I did not observe any marks on [VICTIM #1]’s neck. [VICTIM #1] complained of her right hand hurting, but I did not observe any visible signs of injury to her hand. When asked by Corporal Shepherd if she felt like she could not breathe when Gerald put his hands around her neck, [VICTIM #1] replied “a little bit.”
EMS assessed [VICTIM #1]’s injuries. Instead of having EMS transport her to the hospital for further evaluation, [WITNESS #1] wished to take [VICTIM #1] to the hospital herself. Photographs were taken and burned to a disk for the case file. They can be found under the “Other Images” tab. [WITNESS #1] and [VICTIM #1] were able to provide me with witness statements, which can be found under “Linked Files”.
Due to Gerald leaving the scene, an arrest was not made at this time. Carroll County warrants were completed for Aggravated Assault Strangulation FVA 16-5-21(a)(3) (Felony), Battery FVA 16-5- 23.1 (Misdemeanor), Criminal Damage to Property 2nd Degree 16-7-23, Theft by Taking 16-8-2 (Misdemeanor), and Cruelty to Children 3rd Degree FVA 16-5-70. They are awaiting a judge’s signature.
