On August 26, 2022, at approximately 0840 hours I, Corporal Tolbert, was patrolling the area of Highway 78 near Westview Drive in my conspicuously marked patrol vehicle equipped with emergency lights and siren.
While patrolling, I observed a Hispanic male sitting on the ground near Bain Dental ([400 BLOCK] West Bankhead Highway). I approached the subject, Guadalupe Moncada and conducted a consensual encounter. I verified Moncada had no issues with voluntarily speaking with me and he advised he did not. While speaking with Moncada, I asked if there was anything the police department could do to help due to him being homeless. Moncada advised he needed a job and steady income.
I stepped away momentarily and spoke and answered a phone call. I looked over as Moncada stood by with Officer Allen. When he pulled his shirt up to scratch his stomach, I clearly observed a meth pipe in waistband. I secured Moncada in handcuffs to the rear and retrieved the pipe which had methamphetamine in the bowl and in the “neck” of the pipe. I had Officer Allen place Moncada in the rear of a patrol vehicle and he was transported to the Carroll County Jail for housing.
It should be noted while in the rear of the patrol vehicle Moncada continued to spontaneously utter that he merely located the pipe on the ground and picked it up. A warrant was completed, and the evidence was logged on receipt VR-018801 and dropped into evidence.
