Officer’s Narrative:

On June, 8, 2022 at approximately 0359 hours, I, responded to the area of Smithfield Rd. and Reynolds Rd. in reference to a possible dispute. Dispatch advised that they were at the fire station. They then advised that she did not stop at the fire station she had just drove by it. Dispatch advised they were trying to get the female to go back to the fire station. They advised that the female had stopped on Smithfield Rd. and had her flashers on. Dispatch advised that the female told them that she had been drinking. A passerby called 911 and advised that the car was stopped in the road way in front of [6000 BLOCK] Smithfield Road.

Upon my arrival, I visually observed the gold Ford Expedition blocking the East bound lane. The vehicle was blocking the entire East bound lane. I met with driver Yohana Garcia which visibly was upset and crying. Yohana had her three children in the vehicle [REDACTED] (14y/o), [REDACTED] (13y/o), and [REDACTED](10y/o) along with a puppy and a goat. I asked Yohana to step out of the vehicle and speak with me at the rear of the vehicle. I smelled the odor of alcoholic beverages on Yohana’s person.

I asked Yohana what had occurred. Yohana advised she was staying with a friend of (3) three months named [REDACTED] (this is the only information Yohana had on her). She stated that she had went to [REDACTED]’s residence and had been drinking and was spending the night. She stated that she woke up to [REDACTED] walking out of the residence butt naked. She stated that she heard [REDACTED] state “fu*k’em” as she was leaving the residence after arguing with her husband. Yohona was not involved in the domestic and no threats were made to her.

Yohana stated that she tried to follow [REDACTED] to make sure she was okay. She stated that [REDACTED] had left the residence and she did not know where she went. She stated that she was scared that [REDACTED] was going to come back and shoot her. When asked why she thought that she stated becasue [REDACTED] was crazy. Yohana stated that she went inside and got her children up and loaded them in the car. She stated she tried to take [REDACTED]’s child as well because he seemed upset but the boyfriend would not let her take him. [REDACTED] stated that her daughter [REDACTED] had called 911 because she was scared.

Yohana stated that she had been drinking. I asked if she would consent to field sobriety evaluations to ensure she would be a safe driver. She consented. As I started Horizontal Gaze Nystagmus (HGN), Yohana could not keep her head straight and was still crying. During HGN Yohana dropped her head and stated that she knows that she is drunk. I asked if she wanted to continue and she shook her head no. We did not continue. I placed Yohana under arrest. I had Yohana call someone to pick her children up. She stated that the closest person would be about (2) two hours away. We transported the children, dog, and goat to the Sheriff’s Office to be picked up by a family member, [REDACTED].

Implied Consent was read and blood was requested. Yohana agreed to give a sample of blood. Yohana was placed under arrest at 0443 hours. I began transporting her to the jail at 0646 hours. The blood draw occurred at 0720 hours. There was an extended time between arrest and blood draw due to extended wait time for a wrecker. Yohana was arrested for DUI, DUI less safe, DUI endangering child under 14y/o x2, and improper stopping in the roadway. The vehicle inventory sheet was completed and turned over to jail reception. Yohana Garcia was transported to the jail without incident. The GBI blood draw kit was turned over to Evidence Tech. G. Holcomb. Citation numbers were 101470, 101471, 101472, 101473, and 101474.
