On Saturday, May 06, 2023 at 23:07 hours, I initiated a traffic stop (Failure to maintain lane) on Highway 307 and Export Boulevard, Garden City, Chatham County, Georgia, 31408.

COMPLAINANT: Sergeant D. Reyes.
On this date at 23:07 hours, I was traveling eastbound on Highway 307, when I observed a vehicle traveling ahead of me, in the right lane, and not maintaining lane. I remained behind the vehicle and observed when the vehicle’s left side tires moved over onto the left lane several times. It was also noted that the driver kept stepping on the brakes and stopping on the roadway with no vehicle ahead.

I activated my emergency blue light and conducted a traffic stop on a gray, Honda, Civic, bearing South Carolina tag [REDACTED]. It was noted the driver passed an illuminated parking lot and stopped at the railroad track before Highway 21.

I approached the left (driver) side of the vehicle and noticed the driver seemed disoriented. I introduced myself and asked the driver to present his driver’s license, Howard Cuadra-Rosales, handed me a driver’s license from Nicaragua and no passport. I asked Howard if he had a valid driver’s license and he stated no.

At the window, I detected a strong odor of an alcoholic beverage emitting from inside the vehicle. I noticed Howard’s face was red and flushed and his eyes were bloodshot, glazed, and watery. I noticed a half empty cold beer bottle in the front passenger seat and on the floorboard.

Based on the aforementioned facts, I asked Howard to step out of the vehicle and walk towards the front-end of my patrol vehicle, which he did. Upon exiting the vehicle, it was noted that Howard had difficulties maintaining his balance when walking.

Next, I moved Howard’s vehicle from the railroad tracks and moved the vehicle to the illuminated parking lot, where I could continue with my DUI investigation. I asked Howard where he was coming from and he stated he was coming from Nassau Woods Mobile Home Park, where he had six beers with friends.

During the interview, I detected a strong odor of an alcoholic beverage coming from his breath and person. I asked Howard if he would submit to a field sobriety test and he stated he would not.

At that time, Howard was placed under arrest and read the Georgia Implied Consent Notice for suspects age 21 or over.

Howard was asked if he would consent to the state administered chemical test of his [BREATH] under the implied consent law, he indicated he would not consent to the state [BREATH] test.

In conclusion, Howard was transported to the Chatham County Detention Center. Howard waived his arraignment and was issued a $5,000.00 bond. Howard was cited accordingly, all citations containing a court date of July 26, 2023 at 13:00 hours. Howard was issued a copy of an Administrative License Suspension and Implied Consent form. His vehicle was towed by Sapp’s Wrecker Services.
