Officer’s Narrative:

On Saturday, July 23, 2022 at 23:22 hours, I initiated a traffic stop (tail lights) on Highway 80 and Chatham Parkway, Garden City, Chatham County, Georgia, 31408.
On this date I observed a vehicle traveling without tail lights eastbound on Highway 80 and Kelly Hill Road in the left lane. I turned my patrol vehicle around and activated my emergency blue lights and siren and conducted a traffic stop on a black, 2020, Mazda, MX-5, displaying Louisiana tag [REDACTED].
The vehicle slowed down and then abruptly yielded to my emergency lights and stopped in the left turn lane on Highway 80 and Chatham Parkway. I approached the left (driver) side of the vehicle and introduced myself and informed the driver he was stopped for driving without tail lights, and I observed the driver was not wearing his seatbelt. The driver, Jarrell Johnson, advised he had just left a funeral in the Pooler, Port Wentworth area.
I asked Jarrell to step out of the vehicle. When I was speaking with Jarrell in front of my patrol vehicle, I observed his eye lids were heavy. Jarrell’s speech was slurred and I detected the odor of an alcoholic beverage coming from his person. I asked Jarrell if had anything to drink. Jarrell stated he had a “few.”
I asked Jarrell how many was a few. Jarrell advised he had consumed two bottles of Seagram’s wine coolers. Jarrell stated he consumed his last drink approximately one hour prior to the stop. I asked Jarrell for his driver’s license. Jarrell initially pulled out an ATM card before handing me his license.
I asked Jarrell if he would submit to a field sobriety test and he stated he would. I asked Jarrell if he had any medical problems with his eyes and he advised no. Jarrell was not wearing eye glasses or contact lenses. Before the eye test, I turned off my patrol vehicle’s front flashing blue lights and had Jarrell turn away from oncoming traffic.
Lighting conditions consisted of my patrol vehicle’s headlights, street lights, and my flashlight. The evaluation was conducted on a smooth, and flat road surface. I asked Jarrell if he had any injuries that would preclude him from walking or turning, and he advised no.
HORIZONTAL GAZE NYSTAGMUS TEST:
I instructed Jarrell to stand with his feet together and place his hands down by his side and to stay in this position. I then held up the tip of my finger to use as the stimulus, which was held approximately 12 to 15 inches away from his face and slightly above eye level. I then advised Jarrell that I was going to make several passes in front of his face and to follow the tip of my finger with his eyes only and to not turn his head. I then asked if he had any questions and he advised no.
I first checked for equal pupil size, which was detected. I then checked for resting nystagmus which was not detected. I then checked for equal tracking in both eyes starting with the subjects left eye and repeated this step. I then checked for lack of smooth pursuit in both eyes starting with the subjects left eye and repeated this step.
I then checked for distinct and sustained nystagmus at maximum deviation in both eyes starting with the subjects left eye and then repeated this step. I then checked for onset of nystagmus prior to 45 degrees in both eyes starting with the subjects left eye and repeated this step. I then checked for vertical nystagmus which was not detected.
During this test I detected a total of [6] clues out of the possible [6] clues. The clues displayed were:
- Lack of smooth pursuit: Left (yes) Right (yes).
- Distinct and sustained nystagmus at maximum deviation: Left (yes) Right (yes).
- Onset of nystagmus prior to 45 degrees: Left (yes) Right (yes).
WALK AND TURN TEST:
I first advised Jarrell to stand with his right foot in front of his left foot, touching heel to toe and place his hands down by his side. Jarrell was advised to stay in this position while I demonstrated and explained this test and to not start or begin until told. I asked if he understood, and he acknowledged he understood.
I advised Jarrell when instructed to take nine steps walking a straight line and touch heel to toe each step. I advised Jarrell on the ninth step to keep his front foot planted on the ground and make a series of small steps until turned back around and then return nine steps touching heel to toe each step.
I also advised Jarrell that during the test, to look down at his feet, count each step out loud, keep his hands down by his side and once he starts to not stop until the test is completed. I demonstrated the entire test and then asked if he understood or had any questions, he indicated he understood. I then advised Jarrell to begin the test.
During this test he displayed a total of [4] clues out of the possible [8] clues. The clues displayed were:
- Cannot balance during instructions – (yes).
- Starts too soon – (yes).
- Stops while walking – (no).
- Misses heel-to-toe – (yes).
- Steps off the line – (yes).
- Uses arms to balance – (no).
- Improper turn – (no).
- Incorrect number of steps – (no).
ONE LEG STAND TEST:
I advised Jarrell to stand with his feet together and place both hands down by his side while I explained and demonstrated the test. Jarrell was advised to not start the test until told to begin. I asked Jarrell if he understood, Jarrell stated yes.
I advised Jarrell when instructed to raise one leg of his choosing approximately six inches off the ground with toes pointed out in front of him, and count out loud in the following manner, 1001, 1002, 1003, 1004, and so on until I tell him to stop. I also advised Jarrell that during the test, to look down at his elevated foot, count out loud, keep his hands down by his side and both of his legs straight.
I demonstrated the entire test and then asked if he understood or had any questions, he indicated he understood. I then advised Jarrell to begin the test.
During this test he displayed a total of [1] clues out of the possible [4] clues. The clues displayed were:
- Sways – (yes).
- Uses arms to balance – (no).
- Hops – (no).
- Puts foot down – (no).
The following cues were noted:
- Raised foot approximately 1″ from the ground, not 6″.
ALCO-SENSOR:
The last test was the field alco-sensor, which was positive for the presence of alcohol.
At that time, Jarrell was placed under arrest and read the Georgia Implied Consent Notice for suspects age 21 or over. Jarrell was asked if he would consent to the state administered chemical test of his breath under the implied consent law, he indicated he would consent to the state breath test. Jarrell was transported to the Garden City Police Department for the state test.
Detective Villegas set up the Intoxilyzer 9000 serial number 90-001009. When the machine was ready, Jarrell provided two proper breath samples that registered at .111 grams and .114 grams. After the state breath tests, he did not request any additional tests of his own.
Jarrell’s vehicle was towed and removed from the scene by Sapp’s Wrecker Service. A GCPD Storage Receipt was issued to Jarrell.
CONCLUSION:
Through my investigation, I was able to observe and detect signs of impairment. The aforementioned evidence revealed Jarrell was driving a motor vehicle while under the influence of alcohol.
Jarrell was transported to the Chatham County Detention Center for processing. Jarrell was issued three citations, driving under the influence of alcohol .08 grams or more, no seatbelt, and no tail lights, all with a court date of September 28, 2022 at 13:00 hours. Jarrell consented to the state breath test, and the results indicated an alcohol concentration of 0.08 grams or more.
Jarrell was issued an Administrative License Suspension and Implied Consent form, DDS 1205. Jarrell waived his right to an arraignment and was issued a bond in the amount of $3,000.00 per Garden City Municipal Court Judge Billy Tomlinson. Jarrell signed the arraignment waiver form acknowledging so.
