Officer’s Narrative:

On August 12, 2022 at approximately 2111 hours, I observed a GMC SIERRA traveling westbound on President Street in the right lane. The vehicle was weaving, and crossed the right fog line. I initiated a traffic stop on the vehicle. The vehicle stopped on the right shoulder of President Street, partially in the right travel lane.

I approached the passenger side of the vehicle and identified the driver as MICHAEL SCOTT PETERS. Mr. Peters was the only occupant in the vehicle. I noticed he had watery bloodshot eyes. There was a strong odor of an alcoholic beverage coming from the inside of the vehicle. When Mr. Peters spoke, I noticed his speech was slurred. Mr. Peters stated he had a couple drinks. I asked him to exit the vehicle.

Mr. Peters was unsteady on his feet as he exited. While speaking with him outside of the vehicle, I confirmed the odor of an alcoholic beverage was coming from his breath. Mr. Peters stated he had three drinks, four hours ago. He stated he was at the beach with his friends. Mr. Peters agreed to Standardized Field Sobriety Testing.


HGN – Mr. Peters had lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and onset of nystagmus prior to 45 degrees in both eyes. He wobbled as I checked his eyes.

Walk and Turn – Mr. Peters lost balance during the instruction. He made nine initial steps, using his arms for balance. He stopped before attempting the turn. Mr. Peters turned improperly, without planting his leading foot. He made nine returning steps, using his arms for balance. He missed heel-to-toe steps in both directions.

One Leg Stand – Mr. Peters used his arms for balance, swayed and put his foot down multiple times.

PBT – Mr. Peters refused to give a breath sample into the Alco Sensor FST.

I arrested Mr. Peters for DUI and read him the Georgia Implied Consent Notice for suspects age 21 or over. Mr. Peters refused the blood test by stating, “Negative.” I placed Mr. Peters in the rear of my patrol vehicle, then checked his vehicle for evidence of intoxication. I found a plastic cup with a small amount and beer remaining in the vehicle’s center cup holder. I also found a foam cup partially filled with a Margarita in another center cup holder.

After Sapp’s Wrecker service removed Mr. Peters’ vehicle, I transported him to the Chatham County Jail. I issued Mr. Peters a DDS 1205 form and his charges while at the Jail.
