On November 30, 2022, at approximately 0432 hours, I responded to 6 E Gateway Blvd. (Motel 6) in reference to a domestic dispute in Chatham County.

On my arrival, I spoke with Nicole Leavell, who appeared to be in emotional distress. He would later state that he had been using “meth” overnight. He informed me, he and his girlfriend ([VICTIM #1]) have been living together for four months and the two of them continue to get into a physical altercations. On 11/30/22, around 0330 hours, [VICTIM #1] would bite Mr. Leavell near his left shoulder. He then showed me the marks that [VICTIM #1] left from the bite. He stated she did that because she wanted him to go to the store and he did not want to go. He would eventually call for the police one hour later.

While speaking with Mr. Leavell, he was unable to provide a clear timeline of events and would talk about past injuries sustained from physical altercations with Ms. [VICTIM #1]. Those injuries were visible on his face and none of them appeared to be fresh or new injuries.

Ofc. Nesmith would inform Ms. [VICTIM #1] was grabbed from behind and bite [Mr]. Leavell. He said she stated she was trying to get away from Mr. Leavell. I would ask Mr. Leavell about what she said. He informed me he had grabbed her from behind after she grabbed his hands and placed them on her breast. She then went into the bathroom. When she exited the bathroom, she was vocally arguing with Mr. Leavell.

I then spoke with Ms. [VICTIM #1]. She stated, Mr. Leavell was becoming erratic in his behavior and she was becoming concerned with her well-being. She did not want physical harm to come to her and she wanted to distance herself from Mr. Leavell. She would tell him that she was leaving to go to the store. Mr. Leavell would grab Ms. [VICTIM #1] from behind and wrap one of his arms around her neck. She stated he was grabbing her and attempting to keep her from leaving. She would bite Mr. Leavell in an attempt to get him to let her go. She was able to get free from his hold and left the room they were staying in.

The two would eventually make their way to the lobby of the Motel 6 as Ms. [VICTIM #1] was trying to get away from Mr. Leavell. She stated, she saw the overnight front desk auditor and used him to shield herself from Mr. Leavell. She believed Mr. Leavell was going to physically harm her to the point of receiving a violent injury.

I spoke with the Night Auditor of Motel 6, [WITNESS #1]. He stated, Ms. [VICTIM #1] and Mr. Leavell were verbally arguing as they entered the lobby. Mr. Leavell appeared to be approaching Ms. [VICTIM #1] as if he was going to cause physical harm to her. Ms. [VICTIM #1] then used him as a physical barrier to keep Mr. Leavell away from her.

My investigation lead me to identify Mr. Leavell as the predominant aggressor in this incident. I placed Mr. Leavell under arrest and informed him he was being arrested for Simple Assault under the domestic violence act. He was placed in double-locking handcuffs, checked for fit, and pressed checked. I search Mr. Leavell incident to arrest and placed him in the passenger side rear of my marked patrol unit. He was secured with a seatbelt in the rear seat.

Lethality screening was filled out and Ms. [VICTIM #1] screened in from the answers provided. She refused to speak with Safe Shelter and to contact them. She was provided a case report number and informed of the resources available to her. Photos were taken and uploaded to Axon Capture of Ms. [VICTIM #1] and Mr. Leavell.

Mr. Leavell was transported to Memorial Medical Center to be cleared. Cpl. Roberts would take custody of Mr. Leavell and his property at Memorial Medical Center.

Ms. [VICTIM #1] would not provide contact information and stated she did not have any phone number to provide or an email address. She is currently homeless and leaves in the area of Gateway Blvd/I95.
