On 10/07/2021, at 2234 hours, I was traveling on Hwy 154 when I observed a yellow Mitsubishi (GA#[REDACTED]) traveling in front of me. I began pacing the vehicle which was driving at speeds of 55-60mph in a 45mph zone. I was still attempting to pace the vehicle as we approached Willis Rd when the vehicle signaled and turned into Fraziers, which was currently closed. At that time, I activated my emergency equipment and initiated a traffic stop.

I made contact with the driver, Angel Chavez, [REDACTED BY AGENCY] and detected the odor of burnt marijuana. I also observed the front passenger, Victoria Roof [REDACTED BY AGENCY], and asked them if they had anything illegal in the vehicle. I observed Victoria look down in the area of her feet when I asked and the driver responded “not with me”. I had Angel exit the vehicle and questioned him further about marijuana in his vehicle and he was very cooperative and told me there might be some in the middle console and ashtray.

I returned to the vehicle and had Victoria exit the vehicle. I asked her if she had anything illegal in her possession and she said no. I then had the rear passenger, [REDACTED BY AGENCY] exit the vehicle. As I searched the vehicle for the marijuana Angel admitted to, I observed two Seagram’s “Escapes” alcoholic beverages in the front passenger floorboard. Both of them had condensation on the outside suggesting they were cold and one of them was open and almost empty.

At that time, Victoria was placed under arrest for minor in possession of alcohol. I placed her hand handcuffs behind her back, which I checked for a proper fit and double locked. I searched her incident to arrest and she advised me that she had marijuana hidden inside her bra. I then placed her in the cleared backseat of my patrol car.

Angel was issued a warning for his speed and they were released. Victoria was transported to Coweta County Jail where the marijuana was recovered by jail staff. She was charged with Minor in Possession of Alcohol (OCGA 3-3-23), Open Container of Alcohol (OCGA 40-6-253), and VGCSA – Poss. Of Marijuana Less Than (OCGA 16-13-30) and a warrantless affidavit was completed. Photos of the marijuana and alcohol were taken and the marijuana was submitted into evidence. Nothing further at this time. BWC was active.
