Man jumps into moving car, charged with disorderly conduct

ALBANY – The following incident report was filed by the Albany Police Department regarding the arrest of Justin Michael Day, 30, on July 27, 2020 on charges of disorderly conduct and interfering with city officers.

I responded in normal mode to [1500 block] N Slappey Blvd in reference to disorderly conduct.

Upon arrival I made contact with Justin Day. Justin advised that he met with his child’s mother, Richele Bodiford, to return their child back to her. Justin advised Richele placed their son in the backseat of her vehicle and got into the vehicle. Justin stated that Richele advised him while in the driver seat of her vehicle that he would never see his son again.

Justin stated that he became upset and jumped inside of Richele’s moving vehicle. Justin stated while in the car while it was moving he told Richele to stop the car because she’s kidnapping him. Justin stated he eventually jumped out of the vehicle. I observered scrapes and bleeding on Justin ‘s left arm and hands. Justin advised he did not need EMS.

I made contact with Richele. Richele advised that she met with Justin to get her child back. She advised that while she was getting her son Justin was making remarks about her new boyfriend. Richele advised she told Justin she did not want to talk about her new boyfriend, because it was irrelevant to their relationship.

Richele stated Justin became upset and started calling her a “bi*ch.” Richele stated once her son was buckled in the back seat she got into the driver side and began to drive off. While driving off she told Justin “…see this is why I dont let you see him.” Richele stated she was refering to her son, because Justin always gets upset and acts out.

I made contact with Justin at [2800 block] N Slappey Blvd to issue him a citation (AAOl 1557) for disorderly conduct. Justin refused to sign citation. While on scene dispatch advised me that Justin was in possession of the child’s prescribed medicine. When asked did he still have his child’s medicine he told me yes but Richele will have to meet him at his house to get the child’s medicine. I told Justin to give me the child’s medicine. Justin responded by saying he did not have the medicine and it was at his house. I asked Justin a second time to give me the medicine; Justin threw the medicine out of his driver side window.

I told Justin to exit the vehicle he is under arrest. Justin was under arrest for interference with a city officer,Citation (AAO 11558). Justin got out of his vehicle and was handcuff and searched incident to arrest. Justin was placed in the rear of my patrol vehicle and transported to Dougherty County Jail. Justin was released to their staff.

I checked the rear of my patrol vehicle for any weapons or contraband; yield negative results. Upon leaving the Dougherty County Jail I made contact with Richele at Walmart (262 Cordele Rd). I gave the medicine that was prescibed to their son back to Richele.

This case was cleared by an arrest.
