Officer’s Narrative:

I (Ptl. Moses) responded in normal mode to 401 W. Oglethorpe Blvd. (Church’s Chicken) in reference to a suspicious vehicle. Dispatch advised that a silver car was sitting in the drive thru and the driver was asleep blocking multiple customers.
Upon arrival I observed a Silver Mercury Grand Marquis (GA tag# [REDACTED]) sitting in the drive thru line running. I approached the vehicle and observed a black male in the driver’s seat that seemed to be a bit spaced out but he was awake and breathing. I looked inside of the vehicle and saw two blue cans of beer in a black shopping bag on the passenger seat. I asked the driver to show me his license and Ptl. Pugh had him pull the vehicle out of line and park out of the way of the other customers. I ran the driver’s (Jerome Brown) information in GCIC/NCIC and it was determined that he did not have any warrants.
I asked the Brown to step out of the vehicle and he swayed as he stood in front of me. I instantly smelled a strong odor of an alcoholic beverage on his breath while he was breathing and standing about 3 feet away from me. I asked Brown where he lived and he told me “[1500 BLOCK] Avalon” and when I asked him a second time he stated “[1500 BLOCK] W. Gordon”. Brown’s eyes were glossed over at the time of the incident. Ptl. Pugh asked Brown if he was drinking and driving and he told us he was. Brown stated he was on his way home from work and stopped to grab drinks from the store then headed to grab food with slurred speech. Ptl. Pugh asked Brown how much he had to drink and he advised he had one beer.
I placed Brown into handcuffs (double locked and checked for tightness) behind his back and searched him incident to arrest. No weapons or paraphernalia were found on his person. I placed Brown into the back of my patrol vehicle (18-220). I then searched the vehicle for intoxicants and found the two cans of Bud Light beer (cool to the touch, covered with condensation, and still sealed) previously mentioned. I disposed of both containers. I then took Brown to the Dougherty County Jail.
Upon my arrival to the jail, I secured my weapon (Glock G22 Serial #PSL928) in the trunk of my vehicle. I took Brown out of my vehicle and escorted him inside to be released to jail staff. I read Brown his implied consent and Santorear Wakefield administered the breath test and Brown measured at 0.127 (BAC). After leaving the jail, I searched the back of the vehicle for possible weapons and paraphernalia left behind by Brown and none were found. Brown was charged with DUI Per Se (citation #D284172) and released to intake staff on a citation.
This case is cleared by arrest.
