CRIMINAL DAMAGE TO PROPERTY – 2ND DEGREE(FVA)

On July 1, 2022 I, Officer Wright, responded to [REDACTED BY AGENCY] in the Turtle Creek Subdivision. The complainant/victim said her son was having a possible [REDACTED BY AGENCY] and damaging the residence.
I arrived on scene making contact with the victim, identified as [VICTIM #1], who said her son, identified as Malincoln Smith, was in the garage of the residence damaging property. Ms. [VICTIM #1] said the two of them where talking about Mr. Smith having a job. Ms. [VICTIM #1] said during the conversation, Mr. Smith just became angry and started picking up items and throwing them around. Ms. [VICTIM #1] said this frightened her so she locked Mr. Smith in the garage and left with her other child to call 911. Ms. [VICTIM #1] said she has seen indication that Mr. Smith is having [REDACTED BY AGENCY] but has not been able to get him any help.
I approached the residence to make contact with Mr. Smith who was in the garage. Officer Wilson and I located an open rear door to the residence leading into the garage. I made verbal contact with Mr. Smith from outside and asked if he could step out and speak with me. Mr. Smith who was at this point sitting on a couch became very angry that the police department had been call and started throwing what looked like clothing around the garage.
After a brief moment Mr. Smith walked out the door and into the back yard. I observed that Mr. Smith was still extremely upset so I asked him to walk into the front yard so we could just talk. In the process of walking into the front yard Mr. Smith knocked over a large green trash can which as a result placed a large dent in the front passenger side panel and left a small amount of green paint transfer. After doing this Mr. Smith then punched the passenger rear quarter glass busting the glass and causing an injury to his right arm. I was able to calm Mr. Smith down so Lt. S Bashlor and a civilian crisis intervention worker could speak with him.
During the conversation Lt. Bashlor informed Mr. Smith he was going to be charged under the family violence act for the damage but was working on a solution to also get him help with his [REDACTED BY AGENCY]. Mr. Smith was transported to the South East Georgia Health System for evaluation and clearance for the jail. During the evaluation it was determined he did not meet the criteria for referral to the mental health facility and was provided with clearance for jail. Officer Brandonberry transported Mr. Smith from the residence to the hospital and to the Glynn County Detention Center after receiving the clearance paperwork.
Mr. Smith was charged with Criminal Damage to Property 2nd Degree under the Family Violence Act. During the investigation It was established that the victim was the mother of Mr. Smith and the two currently lived in the same household.
