On 05/28/22, at 1309 hours, I, Dep. S. Reynolds, was dispatched to mile marker 131 on I-75S, in reference to a disabled vehicle.

Upon arrival, I made contact with the arrested, Felipe Deleon, who was in the driver’s seat of a red 2003 Honda Odyssey (TN temporary tag [REDACTED BY AGENCY]). Felipe spoke broken english, so I was unable to determine what was wrong with the vehicle. Felipe stated he was attempting to get to the next exit safely.

I asked Felipe for his driver’s license, and he said “I do not have a license.” Felipe handed me a Consular ID Card out of Guatemala ID #[REDACTED], with an address in Tennessee. I asked Felipe if he had a stamped passport and a driver’s license from Guatemala, and he said “no.”

I saw five (5) passengers in the vehicle with Felipe and asked if anyone had a driver’s license, and Felipe said “no.” I requested Dep. K. Ferguson be en route to my location. I then requested the on call wrecker service be en route to my location.

I instructed Felipe to exit the vehicle, and walk back in front of my patrol vehicle, unit # 842. I told Felipe he was under arrest for Driving Without a Valid Drivers License (misdemeanor). I secured Felipe in handcuffs behind the back. The handcuffs were checked for proper fit and double locked.

Felipe was searched incident to arrest and secured in the rear passenger seat of unit # 842. Dep. Ferguson arrived on scene and spoke with the passengers involved other 1, [REDACTED], involved other 2, [REDACTED], involved other 3, [REDACTED], involved other 5, [REDACTED].

Dep. Ferguson advised me there was not a child safety seat for involved other 4, [REDACTED BY AGENCY], who was sitting in the second rear seat of the vehicle with [REDACTED]. I spoke with Felipe about [REDACTED BY AGENCY] not being secured in the safety seat while Dep. Ferguson located a safety seat for transport. I told Felipe he was also being charged with Safety Restraints Required for Children (misdemeanor).

Dep. Ferguson advised me Dep. R. Labny was en route with a car seat, and was going to help transport the passengers to 107 Iffie Rd. (Circle K).

Dep. Ferguson advised he would complete a tow log for the vehicle, while I transported Felipe to the Houston County Detention Center.

I transported Felipe to the detention center. Felipe was issued a citation for Driving Without a License (A-246356), and Safety Restraints Required for Children (A-246357), and turned over to the detention center.

The vehicle was turned over to Peach State Towing, and the passengers were transported to the Circle K.
