On Sunday, March 13, 2022, at approximately 0401 hours, I, Deputy Stewart, was dispatched to [100 BLOCK] Pinewood Drive in reference to shots fired.

Prior to my arrival, Darius Thomas told the call taker that someone is shooting at his residence.

Upon my arrival, I made contact with Darius, who had walked out the next door neighbor’s residence. Darius was walking toward me in a fast pace, when I told him to stop and stand in front of my patrol vehicle. He was talking very loudly and was not making sense. While talking to him, I could detect a strong odor of alcoholic beverage coming from his person.

James Bausik then exits the same residence Darius came from. James was bleeding severely from his face. I told him to stop walking, which he ignored my commands. I then placed James in handcuffs, checked for proper fitting and double locked.

I could detect a strong odor of alcoholic beverage coming from his person. He was very agitated and would not follow commands. I walked him to the front of my patrol vehicle, while Deputy Ondik placed Darius in handcuffs and secured him in the rear of his patrol vehicle.

I advised Central to have EMS en route to our location for James’ face. While waiting on EMS, I attempted to gather information from James, but he kept telling me “shut the fu*k up.” Deputy Craig arrived on scene and stood by with James while I attempted to gather information on what happened.

I made contact with Darius in the rear of Deputy Ondik’s vehicle. I read him his Miranda rights, which he stated he would talk to me without a lawyer present. Darius advised me that he and James went out drinking at a bar.

When they arrived home, they got into a verbal altercation. He stated they resolved their differences and seperated for the night. Darius stated he was inside his bedroom of his residence, when he heard what appeared to be gun shots. One of the shots entered the bedroom through the wall. He stated he then called 911.

After calling 911, Darius saw James running to the neighbor’s house, so he chased after him and began to assault James. Darius admitted to hitting James several times in the face, and admitted he knocked James out at one time.

I made contact with [WITNESS #1], who stated she saw James shooting a rifle at Darius’ residence. She stated she then went to James and took the firearm from him. The rifle is a Gamo, Pellet rifle, entered into evidence. After she took the rifle from James, he ran to the neighbor’s residence.

EMS arrived on scene and looked over James and stated he possibly needed to go to the Hospital due to previous facial injuries. I advised Cpl. Harper of the situation, who stated to turn James over to EMS and I could seek warrants on him on a later date. James was then turned over to EMS, but I will be seeking warrants on James for aggravated assault.

At the time I was unsure if I was going to charge Darius for battery, so I released him. I will also be seeking warrants on Darius for Battery. Darius was not acting in self defense when he assaulted James.

Photos of the holes in the side of [100 BLOCK] Pinewood Drive was taken and entered into the report. The pellet rifle was also collected and entered into evidence.
