Officer’s Narrative:

On 10/30/2021 at 1733 hrs., I, Ofc. Collins, responded to [100 BLOCK] Holly St., in reference to shots fired.

Upon arrival I made contact with other officers on scene. I maintained a perimeter on the west side of the residence while other officers cleared the residence.

I then spoke to a [WITNESS #1]. She advised [VICTIM #1] and Jason Whittaker, arrived at the residence after moving some furniture. She said her boyfriend, Joshua Phillips, was also on scene and was intoxicated. She said he was being “aggravating”. I asked her to explain how he was aggravating. She explained him to be “putting hands in peoples faces” and “making jokes”. She stated Jason began threatening Joshua by saying “I’ll beat your *ss”. She said her sister in law, [VICTIM #2], told her to go to her bedroom in case a fight starts. She advised she went to her room and locked the door.

She stated she heard stumbling down the hall, then the door slams open, and she sees Jason grabbing Joshua by the throat. She stated she jumped up and had to force the door back closed. She said shortly after she did not hear anymore noises so she believed Jason left. She advised [VICTIM #1] and Joshua were last seen having a “heart to heart” conversation when she exited the residence to go on a walk and calm down. She advised while she was out walking she heard gunshots toward her residence so she ran back to the house. She said she was not present when any gunfire occurred.

Lt. Fisher and Sgt. Fussell responded to the scene. Ofc. Lamberth made contact with Joshua Phillips. Ofc. Kim made contact with one victim, [VICTIM #1]. Ofc. Milam was on scene and located shell casings.

I then made contact with [VICTIM #1]’s girlfriend, [VICTIM #2]. She advised Joshua had been drinking all day and they got into several arguments throughout the day. She said when [VICTIM #1] arrived at the residence he got involved in an argument with Joshua. She advised she, [VICTIM #1], and Joshua were outside in the backyard when Joshua presented a gun. She said she stood in between [VICTIM #1] and Joshua when Joshua began to fire the weapon in their direction. Neither party was struck by the gunfire. Joshua then left the scene.

Through gathering statements from Officers on scene and the testimony, it appeared Joshua Phillips presented a gun and shot at or in the direction of [VICTIM #1] and [VICTIM #2] which are two people who live in the residence of [100 BLOCK] Holly Street with Joshua Phillips.

Joshua was taken into custody for two counts of Aggravated Assault Family Violence and one count of Discharging a Firearm within 50 Yards of a Public Roadway. He was transported to Warner Robins Police Department for booking and processing. The firearm used in this incident was not located at the scene. I will secure warrants next available date.
