On 08/02/2022 at approximately 1527 hrs., I, Officer Kim, was dispatched to Houston Medical Center at 1601 Watson Blvd. in reference to a sexual offense.

On scene, I made contact with [VICTIM #1] who stated she had taken a patient, Wayne Frazier, into a room to [REDACTED BY AGENCY]. Ms. [VICTIM #1] stated Mr. Frazier asked her to close the door and she did so. She stated she swabbed Mr. Frazier’s nose but dropped the swab and needed to swab him again. Ms. [VICTIM #1] stated she was swabbing Mr. Frazier’s nose when she felt a light touch on her vag*nal area. She stated she saw Mr. Frazier’s outstretched, cupped hand, with palm facing upward. She stated she moved quickly backward and away from Mr. Frazier. Ms. [VICTIM #1] stated the charge nurse heard Mr. Frazier admit to the act afterward. Ms. [VICTIM #1] stated she wanted to prosecute.

I made contact with Wayne Frazier and his mother, [WITNESS #1], in the emergency department lobby. Due to the nature of the incident, I moved Mr. Frazier and Ms. [WITNESS #1] to a private room. Mr. Frazier’s demeanor and manner of speaking led me to inquire about his ability to answer questions for himself. I asked Ms. [WITNESS #1] if she was a custodian over her son and she stated she was to be with him at all times as a term of his probation. I asked if Mr. Frazier required an advocate of any kind while speaking to me and she stated he did not. Mr. Frazier volunteered that he has [REDACTED BY AGENCY].

I asked Ms. [WITNESS #1] if there was anything else to add and she stated her son was [REDACTED BY AGENCY] which I interpreted as [REDACTED BY AGENCY]. Ms. [WITNESS #1] asked which jail Mr. Frazier was being taken to and Mr. Frazier repeated the question. I asked Mr. Frazier why he thought he was being taken to jail and he began explaining that after Ms. [VICTIM #1] swabbed his nose, he felt the urge to sneeze, so he held his hands out to prevent the sneeze. Mr. Frazier demonstrated, holding his arms straight out in front of him with his palms down. He stated he did not touch Ms. [VICTIM #1].

Mr. Frazier’s hands, while he was seated and with his arms outstretched, are almost level with my shoulders and I am 5’4″. I read Miranda Warning to Mr. Frazier and he declined to speak with me further without an attorney.

I spoke with the charge nurse, [WITNESS #2], who stated she was in a room with Ms. [VICTIM #1], Mr. Frazier, and Ms. [WITNESS #1] when Mr. Frazier admitted to touching Ms. [VICTIM #1] but stated it was an accident. Ms. [WITNESS #2] stated Mr. Frazier began asking Ms. [VICTIM #1] not to press charges.

I provided Ms. [VICTIM #1] with the case number for this report and instructions for obtaining a copy. I advised her I would be seeking a prewarrant hearing in this matter.

I spoke with Ms. [WITNESS #1] again before leaving and asked her confirm the wheelchair Mr. Frazier was in was the same wheelchair in which he was sitting during the incident and she stated it was.
