Officer’s Narrative:

On April 23, 2022 at 1626 hours I, Ofc. Wojtal, was dispatched to the area of 103 Russell Pkwy., Arby’s, in reference to a rolling domestic. Dispatch advised several complainants had called and stated they observed a male punching a woman in the face as they were driving down Russell Parkway

Dispatch advised one complainant was traveling the same direction as them, West, on Russell Pkwy., as I was traveling East toward their location. Dispatch advised the vehicle to be a blue in color van, possibly a Chrysler, and was in the outside lane with the female driving and the male in the passenger seat.

While coming up to the intersection of Russell Pkwy. and Belmont Dr., I observed a light blue in color Chrysler van traveling West in the outside lane with a white female driver and white male passenger. I then turned around behind the vehicle and performed a traffic stop on the vehicle, as I observed the male passenger to not be wearing his seatbelt.

The vehicle, GA tag [REDACTED], then stopped on Russell Pkwy. just West of Corder Road. Upon making contact with the driver, later identified as [VICTIM #1], I observed her right eye to be very swollen, and beginning to be black and blue. The injury did appear to be recent, and I did observe blood to have been wiped on Ms. [VICTIM #1]’s hand.

I then identified the male as Zachary Price and checked both Ms. [VICTIM #1] and him through dispatch as Lt. Trischan arrived on scene with me as backup. Lt. Trischan and myself then placed Mr. Price into custody and advised Mr. Price he was under arrest for Battery- Family Violence, as Mr. Price advised he and Ms. [VICTIM #1] are married and reside together.

Mr. Price then made a spontaneous utterance stating “she slapped me, and I had to hit her, I couldn’t help it”. Mr. Price was then secured into a patrol vehicle and transported to headquarters for processing as I then took photographs of Ms. [VICTIM #1]’s face and obvious injuries. Ms. [VICTIM #1] advised officers she did not want to cooperate and would not provide any information.

I then was able to make contact with [WITNESS #1], witness and complainant, by phone. Ms. [WITNESS #1] advised she did see Mr. Price punching Ms. [VICTIM #1] as she was stopped near them in traffic at S. Davis Dr. and Russell Parkway.

Ms. [WITNESS #1] advised that Ms. [VICTIM #1] even began to honk the horn “as if she needed help” and that the van could be seen moving around as Mr. Price assaulted Ms. [VICTIM #1]. Ms. [WITNESS #1] advised she also saw Ms. [VICTIM #1] swerving as she traveled down the roadway while being assaulted. Ms. [WITNESS #1] was also able to provide me a written statement.

I was also able to make contact with [WITNESS #2], a second witness, who advised she also witnessed Mr. Price striking Ms. [VICTIM #1]. Ms. [WITNESS #2] advised she was behind Mr Price and Ms. [VICTIM #1], and observed Mr. Price striking Ms. [VICTIM #1] as well as Ms. [VICTIM #1] attempting to fight back.

Ms. [WITNESS #2] advised while at a red light, when the light turned green, Ms. [VICTIM #1] was unable to proceed through the signal, as she kept starting and stopping while Mr. Price continued to strike her. Ms. [WITNESS #2] advised she also stayed on the phone with dispatch advising where the vehicle was as it traveled down Russell Parkway, stating she just wanted police to make contact. Ms. [WITNESS #2] also was able to provide me with a written statement.

Ms. [VICTIM #1] was issued a case number and was advised how to obtain a copy of this report. The photographs taken of Ms. [VICTIM #1] have been placed into PISTOL under this case number. The written statements provided by Ms. [WITNESS #2] and Ms. [WITNESS #1] were placed into evidence under this case number. I will be seeking a warrant next available date on Mr. Price for the battery- Family Violence charge.
