On Saturday, June 25, 2022 at approximately 01:08 hours, while traveling in the number 2 westbound lane on Georgia Highway 38 near Bacontown Road, I observed a Black 2021 Nissan Titan with a California tag of [REDACTED], traveling directly in front of my vehicle. I observed the vehicle fail to maintain its lane by traveling over the center white line dividing the number 1 and number 2 westbound lanes. I continued to follow behind the vehicle. The vehicle changed lanes into the number 1 westbound lane. After changing lanes, I observed a green glass bottle thrown from one of the driver side windows of the vehicle. The bottle struck the road in front of my vehicle and busted.

I activated my emergency equipment on my patrol vehicle and conducted a traffic stop with the vehicle on Georgia Highway 38 near Edgewater Drive. Deputy Davis 921 was traveling directly behind me at the time and stopped with me to assist. I conducted a passenger side approach on the vehicle and made contact with the driver, Ms. Kayla Bownes. I explained the reason for the stop and asked all occupants of the vehicle who threw the bottle out. The vehicle had the following occupants: Front seat passenger, Mr. George Clemons, rear backseat driver side, Mr. Alvin Golden, rear backseat center, Ms. Erniyia Golden, rear backseat passenger side, Ms. Ungkana Smith and a juvenile under 6 in an improperly secured car seat in the backseat center which Mr. Clemons stated was his child.

All occupants stated they did not throw a bottle out of the vehicle. I traveled back to where the bottle was thrown from the vehicle which was located on Georgia Highway 38 in front of the Liberty County Community Complex. I located a broken green Heineken beer bottle in the number 2 westbound lane. I came back to the traffic stop and obtained all occupants information. While on scene, I observed an opened 12 pack of green bottled Heineken beer in the rear bed of the vehicle. All occupants, other than the juveniles in the vehicle, were issued a citation for littering.

While speaking to Mr. Golden, I could smell a strong odor of an alcoholic beverage emitting off of his breath. I observed him to have blood shot watery eyes and his speech was slurred. I instructed him out of the vehicle. Out of the vehicle he was very hesitant and unstable on his feet by swaying back and forth. Mr. Golden was placed in double locked handcuffs, behind his back and checked for fit. His person was searched with no findings. He was escorted to the back of Deputy Davis’ patrol vehicle which was searched prior.

Deputy Davis transported Mr. Golden to the Liberty County Jail where he was released to the jail booking staff without incident. Deputy Davis’ patrol vehicle was searched after with no findings. The vehicle and all other occupants were released on scene.
