On Friday June 15 2022, At 0213 hours. I was patrolling on GA-38 near Harrison Drive and observed a black vehicle exit a nearby business parking lot, traveling at a high rate of speed.

I got behind the black Honda Accord ([REDACTED]), While I was following behind the vehicle. I observed the vehicle fail to maintain lane by driving over the white line. The vehicle then failed to maintain lane again by driving over the yellow fog line on the passenger side. The vehicle was driving very erratic and would fluctuate speed.

I got behind the vehicle, activated my emergency equipment and conducted a traffic stop at Ga-38 @ E M L King drive. I approached the driver side window and made contact with the driver (Brandon Roberts) I explained to Mr. Roberts the reason he was pulled over and asked him for his drivers license. While I was standing at the driver side window, I could smell the strong odor of an alcoholic beverage emitting from the vehicle. While I was speaking to Roberts, I noticed a black hand gun laying on the floor at Roberts feet. Roberts started getting agitated and not answering any of my questions. Due to Roberts behavior, I asked Roberts to step out of the vehicle. Sergeant Kilgore (959) arrived on scene.

When I opened Roberts driver door, he got upset because I opened his car door. I asked Roberts to walk to the front of my patrol car. While Roberts was standing at the front of my patrol car, I continued to smelled a strong odor of an alcoholic beverage emitting from Roberts breath. I also noticed Roberts had bloodshot, glazed and watery eyes.

While Roberts was standing outside the vehicle, I asked him where he was coming from. Roberts looked in a different direction and did not answer the question. I told Roberts that I could smell the odor of an alcoholic beverage. Roberts again looked in a different direction and did not answer the question. Roberts said he did not want to answer any questions.

I asked Roberts if he would like to perform field sobriety evaluations to ensure he was safe to drive, Roberts gave a non-verbal no by never answering my question.

I advised Roberts that he was under arrest for driving under the influence. I placed Roberts in handcuffs (double locked and checked for fit) and conducted a search of his person with no contraband findings on his person. I placed Roberts in the backseat of my patrol car. I confirmed Roberts age and read him Georgia’s implied consent notice for suspects 21 and over from the lime green card and requested breath. Roberts did not answer the question at. I read Georgia’s implied consent notice for a second time and requested blood. Roberts gave a non-verbal no.

Robert’s girlfriend, [REDACTED] arrived on scene and took possession of his vehicle, per his request.

I transported Roberts to the Liberty County Jail and released him to the booking staff, along with the listed citations: Driving Under the Influence and failure to maintain lane.

I completed a 1205 Form and submitted it to Department of Driver Services.
