SIMPLE BATTERY – FAMILY VIOLENCE

On Monday, July 11, 2022 at 1816 hours, I was dispatched to [100 BLOCK] Calico Ct. in reference to a domestic. I arrived on scene at 1828 hours, where Deputy Del Rio was making contact with the victim, [VICTIM #1]. I went inside the residence to make contact with Bryan Neal who invited me to the garage to speak. He was Mrs. [VICTIM #1]’s husband. Before speaking about the incident, Mr. Neal stated he had some alcoholic beverages to drink.
Mr. Neal advised me his wife and himself were having a verbal argument that turned physical. He stated he was cleaning the living room when Mrs. [VICTIM #1] told him he needed to clean the kitchen, not the living room. Mr. Neal stated this upset him, so he advised Mrs. [VICTIM #1] he was done. He stated they continued to argue for a while, but eventually stopped arguing when Mrs. [VICTIM #1]’s father left the residence.
Mr. Neal stated they began to argue again and Mrs. [VICTIM #1] told him she would start to move his items out of the residence. He advised me Mrs. [VICTIM #1] was sitting on the couch and when she attempted to stand up, he pushed her back on the couch. I asked him why he did this and he stated she has hit him in the past, so he did not want her to stand up. I was advised Mrs. [VICTIM #1] is eight months pregnant.
Mr. Neal stated they continued to verbally argue until Mrs. [VICTIM #1] went to his game room. He stated the door had a finger print lock on it which Mrs. [VICTIM #1] was able to open. He stated he did not want Mrs. [VICTIM #1] to enter the room and destroy his property, so he grabbed her from behind by placing both arms around her body. He did this to where Mrs. [VICTIM #1] was unable to lift her arms. Mr. Neal stated Mrs. [VICTIM #1] attempted to push him off of her, but was not successful. He advised me during the struggle, they fell to the ground.
Mr. Neal stated he went over to a living room wall and struck it with both his hands, which caused two holes to be left in the wall. He advised he went into the garage where he struck the wall again making two dents in the garage wall. The estimated value of damage was approximately $300. Mr. Neal stated he also threw a gaming chair in the garage which caused it to break. He stated the chair was his and no one else used the chair. He also advised me his two juvenile children witnessed the physical altercation. The ages of the children were 1 and 2. He was unsure of the exact birthdays of the children.
I made contact with Deputy Del Rio and gathered the story which Mrs. [VICTIM #1] advised him. See his supplement for further. I was advised Mrs. [VICTIM #1] did not have any visible injuries on her. EMS was initially dispatched for Mrs. [VICTIM #1] where she was cleared by EMS. She did not go to the hospital with them.
I made contact with Mr. Neal where I requested for him to step out of the residence. Once out of the residence, I placed Mr. Neal under arrest and in double locked handcuffs which were checked for fit. I searched him for contraband and nothing was located. Mr. Neal was placed in the rear seat of my patrol vehicle where he was seatbelted in. The rear seat of my patrol vehicle was cleared of any contraband after the last person was removed from it.
Mrs. [VICTIM #1] was given a victim’s pamphlet and advised how to obtain a copy of this report.
I transported Mr. Neal to the Liberty County Jail where a hold sheet was filled out for Simple Battery and Criminal Trespass. Warrants will be secured for Mr. Neal within the proper time.
Before leaving the jail, I searched the rear seat of my patrol vehicle and did not locate any contraband.
