On Saturday, June 25, 2022 at approximately 1540 hours, I was dispatched to Applebee’s (1492 East Oglethorpe Hwy) in reference to a disturbance. Dispatch advised an anonymous caller stated there was a 6’6 black male in the restaurant harassing customers and trying to fight people. I arrived on scene at 1546 hrs.

I made contact with the hostess, [WITNESS #1]. Ms. [WITNESS #1] stated another guest called 911. There was a male inside the restaurant who was trying to catch a ride from other customers. She stated he was outside taking his clothes off earlier. She also stated he was, “fighting himself”, rolling on the floor and staring out the window. She identified a black male wearing a white shirt and dark colored shorts to me

I made contact with the manager of the restaurant, [WITNESS #2]. Mr. [WITNESS #2] stated he believed the male had something wrong with him mentally. They provided him water and food. Mr. [WITNESS #2] stated the behavior the male was displaying was making other customers in the restaurant uneasy. He stated he would like the male removed from the property.

I made contact with the male, who was later identified as Justin Boyd, near the bar area of the restaurant. I informed Mr. Boyd the manager wanted him to leave the property. Mr. Boyd was talking but he was not making coherent statements. He repeatedly started telling me to leave him alone. He was not complying with my orders to leave the property. I told him numerous times to leave the property but he still did not comply. He walked out of the restaurant and set his food down on the bench in front of the building. He stated, ‘I am right here. This is as far as I’m going.” He continued to make incoherent statements, told me to leave him alone, told me several times to leave and was pacing back and forth while eating his food. At one point he stated, “Tase me or something”. He did not leave the property.

Sgt. Kilgore (959) and Lt. Colvin (936) arrived on scene to assist. Sgt. Kilgore instructed Mr. Boyd numerous times he needed to leave the property and he still refused to comply with commands. Lt. Colvin also gave him numerous orders to leave the property and Mr. Boyd moved to the edge of the landscaped area at the front of the business. However, he still refused to leave the property. Mr. Boyd was still shouting incoherent statements, pacing back and forth and telling us to leave him alone.

Mr. Boyd was placed under arrest for Obstruction (OCGA 16-10-24). Lt. Colvin and Sgt. Kilgore assisted with handcuffing Mr. Boyd. He was placed in handcuffs, which were double locked and check for fit. Lt. Colvin searched Mr. Boyd’s person incident to arrest with no findings. He was escorted to the rear of my patrol vehicle. I transported him to the Liberty County Jail and he was turned over to jail staff without incident. The rear of my patrol vehicle was searched at the start of shift with no contraband being found. Prior to leaving the jail, the rear of my patrol vehicle was searched with no contraband being found.

Mr. Boyd was issued a citation for Obstruction (OCGA 16-10-24) (CIT #: 933000286).
