On Saturday, December 31st, 2022 at 1143 hrs I was dispatched to [100 BLOCK] Marina Drive for an anonymous report of a Domestic. I arrived on scene at 1202 hrs and made contact with [VICTIM #1] and Kathy Nicole Wheeler.
I spoke to Kathy first and she stated she had been told by [VICTIM #1]’s mother [WITNESS #1] to go to [100 BLOCK] Marina Drive and tell some other woman that was supposedly in the house, she had to leave the property. Kathy stated when she tried to walk into the house to find the other woman, [VICTIM #1] told her to get out and grabbed her and pushed her back out of the house.
Kathy stated she felt she had the right to defend herself and scratched [VICTIM #1] across the left side of his face. I noticed several dark red scratch marks, on his left cheek. Kathy stated she was married to [VICTIM #1], but they have an open relationship and do not currently live together. Kathy stated she had permission to be at the house from [VICTIM #1]’s mother, [WITNESS #1] who was not on scene.
Kathy also stated several times she knew she was not supposed to be there because she was criminally trespassed from there, but stated [VICTIM #1] invites her over all the time anyway. Kathy said [VICTIM #1] placed her in a choke hold when removing her from the residence and claimed she had marks on her neck. I checked Kathy’s neck and did not see any cuts or bruises present at that time. Lt. Barnes(928) arrived on scene as back up.
Lt. Barnes and I spoke to [VICTIM #1] about what happened. [VICTIM #1] stated Kathy came to the house because she thinks he is with another woman at the residence. [VICTIM #1] stated when he opened the door Kathy forcefully entered the home stating his mother [WITNESS #1] told her to come there and ask this other woman to leave. [VICTIM #1] stated there is no other woman at the residence and he knows his mother did not tell her to come to the house to try and remove this woman.
[VICTIM #1] stated when Kathy entered the residence he told her to leave and she refused so he picked Kathy up in a bear hug manner and took her back outside of the residence. [VICTIM #1] stated while doing so Kathy was scratching his face up. [VICTIM #1] had several large red scratch marks on his left cheek that looked fresh. [VICTIM #1] stated Kathy did not have permission to come in the residence and she had been criminally trespassed on November 11th, 2022 via case number #221135957 at that residence for a similar situation. [VICTIM #1] stated he and Kathy are separated and do not live together.
Lt. Barnes spoke with [VICTIM #1]’s mother [WITNESS #1] and his father [WITNESS #2] on the phone. [WITNESS #1] stated she never spoke to Kathy until law enforcement was already on scene, and that she did not tell her to go to the home and try to remove anyone from the home. [WITNESS #2] told Lt. Barnes that Kathy is not supposed to be at the residence and she has caused problems there before with [VICTIM #1] and had threatened to beat [WITNESS #2] up prior in text messages.
Kathy was placed under arrest for Battery Family Violence and Criminal trespass. I placed her in handcuffs behind her back, checked for fit and double locked. I then searched Kathy and placed her in the back seat of my vehicle and seat belted her in.
[VICTIM #1] was given a victims pamphlet with case number from Lt. Barnes.
I transported Kathy to the jail and turned her over to booking staff without any issues. First appearance will be completed on the next available date which is Monday 01/02/2023.
My back seat was searched at the beginning of shift and again after transporting Kathy and no contraband was found.
