Child witnesses father get hit by car, driver charged with aggravated assault

DALTON – The following incident report was filed by the Whitfield County Sheriff’s Office regarding the arrest of Brothers, Joshua David, 34, on a charge of Aggravated Assault.

Last names, besides the victim’s, couldn’t be redacted due to the complexity of this incident.

On 06-16-2020 Deputy Carter was dispatched to 1200 Memorial Drive (Hamilton Medical Center) Trauma Room 4. Upon arrival Deputy Carter made contact with a HMC employee in order to be directed to the correct room.

Deputy Carter entered Trauma Room 4. Two nurses were also in the room taking x-rays of the victims legs. The victim was later identified as [VICTIM #1]. Deputy Carter attempted to ascertain information from Mr. [VICTIM #1]. Mr. [VICTIM #1] continuously stated that his head hurt and was uncooperative due to being in pain. Deputy Carter asked Mr. [VICTIM #1] if he could identify the offender and he advised that it was Joshua Brothers, his cousin [REDACTED] Parks’ boyfriend. Two other nurses entered the room and advised Deputy Carter that Mr. [VICTIM #1] would be back soon but they had to take him to have an exam on his head. Deputy Carter left Trauma Room 4 in attempt to make contact with whoever brought him to the hospital.

Deputy Carter made contact with [REDACTED] Powell. She advised Deputy Carter that she was not there when the incident occurred. Ms. Powell explained that Juvenile #1 was there at the incident and directed Deputy Carter to Juvenile #1.

Deputy Carter made contact with Juvenile #1 and he provided the following information. Juvenile #1 and his father [VICTIM #1] were headed to the store when they saw Mr. Brothers and Ms. Parks both standing outside of their vehicle at [2200 block] Waring Road. Juvenile #1 explained that his father pulled over and exited his vehicle. Ms. Parks remained outside of her vehicle while Mr. Brothers got inside of his. Mr. [VICTIM #1] began to walk around the front of the vehicle that Mr. Brothers was in. Suddenly Mr. Brothers accelerated towards Mr. [VICTIM #1]. Mr. [VICTIM #1] jumped straight up into the air to prevent from being ran over. Mr. [VICTIM #1] collided with the hood and windshield of the vehicle. The impact did spider web crack the windshield. Mr. [VICTIM #1] remained on the hood of the vehicle as Mr. Brothers drove away from the scene and swerved the vehicle in order to throw Mr. [VICTIM #1] from off of the hood into the roadway. Juvenile #1 assisted Mr. [VICTIM #1] back into the vehicle. Juvenile #1 drove Mr. [VICTIM #1] home to [2100 block] Waring Road. Juvenile #1, Mr. [VICTIM #1], Ms. Powell and Ms. Parks’ Grandmother drove Mr. [VICTIM #1] to the hospital.

Deputy Carter made contact with Ms. Powell again. Ms. Powell provided the following information. She and Juvenile #1 were going to the store. Ms. Powell saw Ms. Parks and Mr. Brothers outside of their vehicle pulled over on the side of the road. Ms. Powell pulled up to them to see if they were okay. Ms. Powell explained that as soon as she rolled down her window Ms. Parks immediately began stating that “Everything is okay”. Ms. Powell advised that she believed Ms. Parks seemed to be panicked by the way she was yelling. Ms. Powell and Juvenile #1 pulled off from the scene. Ms. Powell explained that she and Juvenile #1 did not go to the store due to a train on the tracks. Juvenile #1 and Ms. Powell turned around and went home. When Ms. Powell arrived home she exited the vehicle. Mr. [VICTIM #1] approached Juvenile #1 who was still in the vehicle. Mr. [VICTIM #1] and Juvenile #1 both left to also go to the store. Ms. Powell stated that she was not with Juvenile #1 and Mr. [VICTIM #1] when they left the residence. When they returned Ms. Parks was with them and Mr. [VICTIM #1] was injured.

Deputy Carter made contact with Mr. [VICTIM #1] due to him being in a more conscious state of mind and he provided the following information. He and Juvenile #1 went to down the road to check on Ms. Parks due to Mr. [VICTIM #1] believing Mr. Brothers was attempting to steal Ms. Parks vehicle. Mr. [VICTIM #1] arrived and exited his vehicle and began to walk around to the front of the vehicle Mr. Brothers was in when suddenly Mr. Brothers “Stomped it”. Mr. [VICTIM #1] also advised that he did jump in order to prevent from being ran over. Mr. [VICTIM #1] was unable to provide further information due to him not remembering.

Deputy Carter spoke to Ms. Parks’ Grandmother. She stated that Ms. Parks was constantly calling her. Deputy Carter asked if it would be okay to speak to Ms. Parks on her phone and she allowed it. Ms. Parks stated that she was not with Mr. Brothers but was at the store. Ms. Parks stated that Mr. Brothers was at a friends house. Deputy Carter could hear a male in the back ground speaking to Ms. Parks. Deputy Carter asked Ms. Parks if it would be possible for her to come to the hospital and meet with Deputy Carter.

Upon Ms. Parks arrival Deputy Carter spoke to her again. Ms. Parks arrived with Mr. Brothers. Deputy Carter heard Mr. Brothers speaking to Ms. Parks. Deputy Carter recognized the voice. Deputy Carter asked Ms. Parks if she had lied to him about the where abouts of Mr. Brothers and she stated that she did not. Deputy Carter explained to Ms. Parks that he did hear Mr. Brothers speaking to her when she was on the phone with Deputy Carter. Deputy Carter explained the seriousness of the situation and advised her that if she did lie about anything else pertaining to the case she would be arrested for obstruction. Ms. Parks began to cry and stated that she would tell the truth.

Ms. Parks went on to explain that her mother Ms. Powell and Juvenile #1 drove by her and Mr. Brothers when they were pulled over. Ms. Powell was screaming at her and Mr. Brothers while they were driving by. Ms. Powell turned around and left. A few moments later Mr. [VICTIM #1] and Juvenile #1 returned. Mr. [VICTIM #1] exited his vehicle while yelling at Mr. Brothers. Mr. Brother entered his vehicle as Mr. [VICTIM #1] was getting out of his vehicle. Mr. Brothers remained in his vehicle. Mr. [VICTIM #1] began punching the passenger side of the windshield, causing the windshield to spider web. Mr. Brothers attempted to drive away but Mr. [VICTIM #1] jumped on the hood of the vehicle. Mr. Brothers continued to drive in attempt to get away from Mr. [VICTIM #1]. Mr. [VICTIM #1] then fell off of the hood of the vehicle while it was moving. Ms. Parks, Juvenile #1 and Mr. [VICTIM #1] returned to Mr. [VICTIM #1]’s residence. After Juvenile #1, Mr. [VICTIM #1], Ms. Powell, and Ms. Parks’ grandmother left Mr. Brothers returned to Mr. [VICTIM #1]’s address and picked up Ms. Parks.

Deputy Carter spoke to Mr. Brothers and he provided the following information. He and Ms. Parks were pulled over. Ms. Powell and Juvenile #1 drove by and yelled at him and Ms. Parks. Ms. Powell turned around and went back towards Mr. [VICTIM #1]’s residence. Soon after, Mr. [VICTIM #1] and Juvenile #1 returned. Mr. [VICTIM #1] exited his vehicle and began to approach Mr. Brothers vehicle. Mr. Brothers entered the driver seat of the vehicle. Mr. Brothers explained that he was afraid of Mr. [VICTIM #1] due to a history of violence between them. Mr. Brothers did not see any weapons. Mr. Brothers stated that Mr. [VICTIM #1] had caused damage to his vehicles in the past. Mr. Brothers advised that Mr. [VICTIM #1] began to jump on the windshield of the vehicle causing it to spider web. Mr. Brothers attempted to drive away while Mr. [VICTIM #1] was holding onto the vehicle. Mr. [VICTIM #1] eventually let go and fell off of the vehicle. Mr. Brothers continued and left the scene.

Deputy Carter placed Mr. Brothers under arrest for Aggravated Assault OCGA 16-5-21 (WA#62186). Mr. Brothers did use the vehicle offensively against Mr. [VICTIM #1]. The vehicle did cause damage to Mr. [VICTIM #1]’s forehead that required stitches. Mr. [VICTIM #1] also had several road rash marks on his hands, arms and the left side of his face. In the manner the vehicle was used, it was likely to causing death or serious injuries to Mr. [VICTIM #1]. The vehicle (RVP0500) used in this incident to hit Mr. [VICTIM #1] was a 1994 Bronze Nissan Altima. The owner of the vehicle is Ms. Parks.

This case is cleared by Arrest.
