Dalton mom arrested for “thumping” 9-year-old neighbor

DALTON – The following incident report was filed by the Dalton Police Department regarding the arrest of Hardaway, Mercedes Cierra (born in 1991), on June 30, 2020 on a charge of simple battery against a 9-year-old child.

We are also investigating an arrest in Whitfield County two weeks prior for Simple Battery, Criminal Trespass, and Disorderly Conduct.

On 06/30/2020, Ofc. Oneal and I, Ofc. Perez, were dispatched to [1000 block] Willowdale Rd in reference to a disturbance involving a juvenile and parents. The complainant had stated that the dispute was over her 9 year old [hearby called Juvenile #1] wishing to play with another child and the suspect was making threats to fight the complainant and her 9 year old child.

Once on scene I made contact with [Victim #1]. [VICTIM #1] stated her 9 year old son, [JUVENILE #1] had gone to unit [100 block] to ask to play with an 11 year old girl who lives in that unit.

[VICTIM #1] stated that the mother of the 11 year old, Mercedes Hardaway had told [REDACTED] he could not play with her daughter.

[VICTIM #1] stated that [JUVENILE #1] then returned to unit [300 block].

[VICTIM #1] stated that Mercedes then came to unit [300 block] and was yelling stating she didn’t want [JUVENILE #1] back at her unit and was going to beat [VICTIM #1] and [JUVENILE #1]’s ass.

[VICTIM #1] stated at one point, Mercedes “thumped” [JUVENILE #1] on the forehead. I did not see any visible marks and [VICTIM #1] stated EMS was not needed. [VICTIM #1] stated that Mercedes flicked her fingers and “thumped” [JUVENILE #1] on the forehead.

[VICTIM #1] stated Mercedes attempted to enter their unit but [VICTIM #1] prevented her from doing so.

[WITNESS #1] advised he had witnessed the above actions.

I then relocated to unit [100 block]. As I was walking up to the unit, a female and male walked out of the unit. I walked up and greeted the individuals and asked who had thumped the 9 year old.

The female advised she had. The female was later identified as Mercedes Hardaway. I asked Mercedes why she had thumped the 9 year old. Mercedes stated that [JUVENILE #1] had been coming to her unit asking to see her 11 year old daughter and she advised him to stop coming over looking for her.

I asked Mercedes what made it reach the level that she felt the need to thump him on the forehead. Mercedes would only state that she did not want [JUVENILE #1] knocking at her door asking to see her daughter because he wasn’t trying to play with her.

I asked Mercedes to clarify what she meant if she didn’t believe that [JUVENILE #1] was there to play. Mercedes would only laugh and say [JUVENILE #1] was there for other reasons and it was not playing.

Mercedes never provided reasoning for her thumping on the forehead.

I then relocated to speak to [VICTIM #1] again. [VICTIM #1] stated she did wish to press charges.

I then returned to Mercedes’s location and advised her she was under arrest for simple battery.

Mercedes opted to leave her wallet at her unit with [REDACTED]. Mercedes was then handcuffed and moved to the area of my patrol vehicle due to Mercedes kicking her unit door open after being placed in handcuffs.

As I was walking Mercedes to my patrol vehicle to be searched, Mercedes was stiffening her arm in an attempt to slightly pull away.

I stopped Mercedes in front of my vehicle and searched her incident to arrest. A lighter was found on her person that she wished to leave at her unit. Nothing else of value was found on her person.

As I was walking Mercedes to the back of my patrol car, Mercedes again stiffened her arm but this time Mercedes pushed her arm and elbow into my chest, slightly pushing me off balance. I advised mercedes to stop trying to push me. Mercedes denied trying to pushing me. Mercedes was then placed in the back of my patrol car and seat belted in for her safety.

Mercedes stated she is a U.S. Citizen. The back seat of my patrol car was searched before and after transport with nothing of significance found.

On the ride to the jail, Mercedes stated that “that little boy needed his ass beat” among other statements regarding the 9 year old and his mother.

Mercedes was then transported to WCSO jail and charged on warrantless arrest #62373 with 16-5-23 simple battery.

Mercedes was left in the custody of WCSO jail personnel.
