On 8/24/2020 Deputy Small was dispatched to the area Boyles Mill Rd and Bowers Rd in reference to a man in an orange shirt sitting in the middle of the road.

Upon arrival Deputy Small made contact with Robert Buck who was sitting on the side of a road drinking a 24 oz Earthquake high gravity lager with another one in a bag. Mr. Buck told Deputy Small he had 4 or 5 beers this date and is always drinking.

Deputy Small advised Mr. Buck he was on a hill and it was very dangerous with his level of intoxication. Deputy Small asked Mr. Buck if he wanted a ride home, Mr. Buck denied the offer.

Deputy Small then told Mr. Buck either he could get a ride home or he would be placed under arrest for pedestrian under the influence. Mr. Buck responded with “take me to the pound.” Mr. Buck was not able to keep his balance nor stand due to the level of his intoxication.

Deputy Small placed Mr. Buck under arrest and transported him to Whitfield County Jail where he was turned over to booking staff. Mr. Buck provided booking staff a sample of his breath to obtain his level of intoxication. The sample provided showed a BAC of .298%.

Mr. Buck was arrested on warrantless arrest # 63147 OCGA 40-6-95 Pedestrian Under the Influence of Alcohol.
