On this date, 10/30/2021, I responded to [REDACTED BY AGENCY] regarding a domestic disturbance.

Upon my arrival, I made contact with officer Johnson who also arrived on scene. We located the apartment and also located the male suspect inside the residence. While approaching the residence, I noticed the apartment door was open and a glass door was present so I was able to look inside the residence. I noticed a male subject walking in the living room. The male appeared to be agitated and knew we were there. I instructed the male to come outside and speak with me. The male complied and came outside. Officer Johnson went inside to make contact with the caller.

While outside with the male suspect, I was able to identify him as Anthony Folks. I asked Anthony what had occurred prior to our arrival. Anthony stated he was sleeping inside the residence. Anthony stated he woke up and began looking for his headphones. Anthony stated he went to [REDACTED BY AGENCY] room and asked if she knew where his headphones were. [REDACTED BY AGENCY] was identified as [REDACTED BY AGENCY]. Anthony stated when he asked [REDACTED BY AGENCY] where his headphones were, his [REDACTED BY AGENCY] began giving him an attitude. Anthony stated he then became irate and started yelling at them. At this point, [REDACTED BY AGENCY] locked themselves inside a bedroom. Anthony then admitted to banging on the locked bedroom door and stating to [REDACTED BY AGENCY] that he was going to kill them.

Officer Johnson came outside to confirm Anthony’s statement. After Anthony admitted to saying he was going to kill them during the altercation, it was determined to place Anthony under arrest for simple assault family violence. Officer Johnson instructed Anthony to place his hands behind his back. Anthony complied and then officer Johnson placed handcuffs on Anthony. I escorted Anthony to my patrol car and conducted a search of his person. After searching his person, officer Johnson placed Anthony in the rear passenger seat of my patrol car. Officer Johnson asked Anthony if he was a US citizen and Anthony stated yes. Officer Johnson asked Anthony if he wished to be safety belted in and he stated no. After placing Anthony in my patrol car, officer Johnson advised me that while speaking with [VICTIM #1] and [VICTIM #2], they stated they were in fear for their lives during the incident.

I transported Anthony to the Whitfield county jail and completed a warrantless arrest form (WA#64743) for two counts of simple battery family violence. The charges were determined due to Anthony causing [REDACTED BY AGENCY] to fear for their lives during the incident. I also charged Anthony with terroristic threats due to him telling [REDACTED BY AGENCY] that he was going to kill them during the incident. This case is cleared by arrest.
