Officer’s Narrative:

On this date, 05/19/2022, I, Ofc. Bell, and Ofc. Oneal responded to [700 BLOCK] Cascade Dr in reference to [VICTIM #1] finding marijuana as well as a firearm in her 19 year old son’s room.

Once on scene, I made contact with [VICTIM #1] and her daughter, [WITNESS #1]. [WITNESS #1] was there to translate for [VICTIM #1] as she only spoke Spanish. [VICTIM #1] advised that her son, Arturo Lemus, was at work today. While Arturo was at work, [VICTIM #1] cleaned up the house.

While cleaning Arturo’s bedroom, she located 2 grocery bags and looked inside to see if they were trash. [VICTIM #1] then observed a large quantity of marijuana. She also located a firearm beside the bags of marijuana. [VICTIM #1] advised that she did not want this in her house and that she knew she needed to call 911.

I asked [VICTIM #1] where Arturo was currently at which she advised that he was asleep in his room. I asked [VICTIM #1] if Ofc. Oneal and I had permission to enter her house, which she advised that we could. I also asked if Arturo paid rent for his room which [VICTIM #1] stated that he did not.

I then called Sgt. Burger and advised him of the situation. Sgt. Burger advised that a detective would be en route.

Ofc. Oneal and myself then entered into the residence and detained Arturo. A pat down was completed and no contraband or weapons were found. I escorted Arturo to the living room and sat him in the couch until Det. Murray and Det. Kumnick arrived on scene.

During this time, Ofc. Oneal had his “body-pak” recording in order to capture any audio from our interaction with Arturo. I obtained the body-pak from Ofc. Oneal and read Arturo his Miranda Rights. I advised Arturo that he was detained due to the items that his mother found in his room.

I asked Arturo if he knew what items I was referencing which he replied “probably some weed.” I advised Arturo that there was also a firearm located in his room which he stated that he didn’t know anything about.

At this time, Det. Murray and Det. Kumnick both arrived on scene and began speaking with Arturo. Arturo gave consent to searching his room. Ofc. Oneal and I proceeded to Arturo’s room while Det. Murray and Det. Kumnick remained in the living room with Arturo.

While searching Arturo’s bedroom, 2 portable digital scales, 1 larger mainstay scale, multiple gang affiliated clothing attire, a marijuana grinder, a glass smoking pipe, and a small silicone canister of suspected “dab” were located. Photos will be uploaded to this report at a later time. I ran the firearm’s serial# (FA924) through dispatch which they advised that the firearm was clear for any wants.

Once Det. Murray and Det. Kumnick finished speaking with Arturo, I escorted Arturo to my patrol car and searched him in front of my in car patrol camera. Arturo was then placed into the back seat of my patrol car where he was secured by a seatbelt.

Det. Kumnick advised that Arturo confessed to being “affiliated” with the “Southside” gang and that he kept the firearm for protection. I then escorted Arturo to the Whitfield Co. Jail.

Once at the Whitfield Co. Jail, Arturo was turned over to the Whitfield Co. booking staff. I also ran a criminal history on Arturo which confirmed that Arturo was a convicted felon.

Arturo was charged on WA# 64890 for:

  • 16-13-30 j(1); possession with the intent to distribute marijuana (f)
  • 16-13-30; possession of marijuana (f)
  • 16-11-106; possession of a firearm during the commission of a crime
  • 16-11-131; possession of a firearm by a convicted felon
  • 16-15-4; Participation in criminal gang activity
  • 16-13-1; possession of drug related objects

The total quantities of marijuana weighed out to 1.2 lbs of suspected marijuana (in a glass canister) and 142.8 gg of suspected marijuana. All items obtained at the scene where entered into property & evidence. The suspected marijuana will be sent of to the GBI crime lab for further evaluation.
