On November 10, 2021, officer Avila responded to [REDACTED BY AGENCY] Dalton, Ga in reference to a fight in progress.

I was traveling on Stacy Dr towards on Pinehill Dr responding to the fight in progress. I observed three males running across the intersection north on Pinehill Dr crossing Stacy Dr. I stopped my patrol car and ordered the males to stop. They complied and I ordered the males to sit in front of my patrol car. I informed other units responding to my location at Stacy Dr & Pinehill Dr, to continue to [REDACTED BY AGENCY] to figure out what occurred at the original call location.

I identified the three male juveniles as [REDACTED BY AGENCY] was bleeding from his eyebrow area and I notified dispatch to have emergency medical services. I asked the juveniles where are the other males involved in the fight. The juveniles stated they were still up there at [REDACTED BY AGENCY] I looked behind me and I observed two males walking north on Pinehill Dr. I recognized the males as [REDACTED BY AGENCY].

[REDACTED BY AGENCY] began pointing at [REDACTED BY AGENCY] that they were the other involved party in the fight. I ordered [REDACTED BY AGENCY] to stop where they are. I notified Dalton PD units to respond to my location since the other parties involved have walked to my location. Ofc Bethune arrived and stood by with [REDACTED BY AGENCY].

I had [REDACTED BY AGENCY] call their parents in order for me to have their parents present during questioning. [REDACTED BY AGENCY] began to tell me why the fight occurred without me telling them too. The juveniles stated that a male that lives at [REDACTED BY AGENCY] started a disturbance with them in the area of Stacy Dr. The juveniles stated that they found out the male lives on [REDACTED BY AGENCY] and went to the residence looking for him. The juveniles did not state how the fight started or who started the fight.

Hamilton Emergency Medical Services arrived along with [REDACTED BY AGENCY] guardian Brian Hassett. I had them stay where they were while I spoke with REDACTED BY AGENCY about the incident. [REDACTED BY AGENCY] stated that he knows those kids fought his brother. [REDACTED BY AGENCY] stated that he did have to grab the juvenile in the black hoodie [REDACTED BY AGENCY] off of [REDACTED BY AGENCY] his son.

Ofc Hughes informed me via radio that he was transporting a witness to my location to verify suspects that instigated the fight. I went to stand by the juveniles and ofc Hughes informed me that the juveniles in front of my patrol car [REDACTED BY AGENCY] were the aggressors. Ofc Hughes was able to view video footage and I have a copy of the video.

Brian Hassett, [REDACTED BY AGENCY] guardian learned from the juveniles that [REDACTED BY AGENCY] laid hands on the juveniles during the fight. Brian began to get irate and instigating/provoking a fight with the [REDACTED BY AGENCY] family. Both involved parties was in a close proximity by a couple yards. I began to push Brain back while attempting to calm him down. Brian’s brother, Johnny Hassett arrived in a black passenger car escalating the situation. Ofc Bethune went to my location attempting to de-escalate the situation with Johnny.

I continued to make attempts to calm Brian and to stop yelling at the [REDACTED BY AGENCY] Johnny got irate yelling at ofc Bethune and Brian walked left of me yelling and using abusive words towards the [REDACTED BY AGENCY] I grabbed Brian from behind trying to pull him back and Brian began to lift me with his back. I pulled my bodyweight back to the ground and pulled Brian with my body/arms to my right side taking Brian to the ground. When this happened, Johnny began pulling away from ofc Bethune in my direction. Refer to ofc Bethune’s supplemental.

Brian was arrested for obstruction. I searched Brian in front of my patrol car for weapons/contraband. Brian did not have weapons/contraband on his person. Brian was secured in the back seat of my patrol car. Hamilton EMS checked [REDACTED BY AGENCY] cut above his eye with Brian’s permission and was cleared by Hamilton EMS.

[REDACTED BY AGENCY] mother [WITNESS #1] arrived. I asked [WITNESS #1], “is it ok to ask [REDACTED BY AGENCY] questions about the fight?” [WITNESS #1] stated it was ok. [REDACTED BY AGENCY] admitted that they found out where the male lived and went to the residence to find him. [REDACTED BY AGENCY] stated that the male confronted them but nothing happened. I asked [REDACTED BY AGENCY] “when the male turned around and walked away, why did you grab him?” [REDACTED BY AGENCY] did not give an explanation but admitted to grabbing the male [REDACTED BY AGENCY].

Detective Kumnick arrived on scene in response to the fight. Detective Kumnick informed me that [REDACTED BY AGENCY] is a suspect in his case. Detective Kumnick informed me to detain [REDACTED BY AGENCY] and transport [REDACTED BY AGENCY] to the police department for interview. Ofc Womack transported [REDACTED BY AGENCY] to the police department.

I then called juvenile intake in reference to charging [REDACTED BY AGENCY] with 16-11-32 affray and 16-5-90 stalking. I advised juvenile intake of the situation and that [REDACTED BY AGENCY] is being interviewed at the police department. Juvenile intake informed me that [REDACTED BY AGENCY] will be sent to RYDC and that [REDACTED BY AGENCY] and [REDACTED BY AGENCY] will be cited/released.

I explained the citations to [REDACTED BY AGENCY] associated parent/guardian. [REDACTED BY AGENCY] are seen in the video arriving to the [REDACTED BY AGENCY] residence and starting the fight with [REDACTED BY AGENCY].

I transported Brian Hassett to the Whitfield county jail. I charged Brian with 16-10-24 obstructing law enforcement. Brian was placed in custody of the Whitfield county booking staff. I relocated to the Dalton police department. Ofc Womack was waiting with [REDACTED BY AGENCY] in the interview room. I relieved ofc Womack and [REDACTED]’s mother [WITNESS #2] arrived. I stood by while detective Kumnick conducted the interview with [REDACTED BY AGENCY] and his mother. Once interview was completed, I transported [REDACTED BY AGENCY] to RYDC. [REDACTED BY AGENCY] was placed in custody of the RYDC staff and I completed a complaint form. [REDACTED BY AGENCY] was charged with 16-11-32 affray and 16-5-90 stalking. Nothing further.
