On this date, 06/10/2022, I, Ofc. Bell, responded to 815 Shugart Rd in reference to a shoplifting.

Once on scene, I made contact with [WITNESS #1] in the loss prevention Office. [WITNESS #1] already had a male subject in custody and advised that the female that was also involved was in the vehicle in the parking lot. I relocated to the parking lot and located [WITNESS #2] in her vehicle in row 2.

I advised [WITNESS #2] that her boyfriend was in custody for shoplifting and that I needed her to come inside as well. [WITNESS #2] agreed and I escorted her inside.

Once back inside, I asked the male subject for his name. The male gave me the name of Dustin Patterson with a birth date of [REDACTED]. [WITNESS #1] advised that Dustin had given the birth date of [REDACTED] which I asked Dustin to confirm. Dustin advised he was nervous and that it was [REDACTED].

I noticed that [WITNESS #2] also was calling Dustin “Jerry”. I asked Dustin why she would be calling him Jerry which he advised that it was a nickname. I advised Dustin if he aware that giving me a false name would be another charge and he advised he did.

[WITNESS #1] then proceeded to show me video of what happened. I observed [WITNESS #2] hand Dustin the earring and also 2 separate sets of bra’s which “Dustin” proceeded to pull the tags off of. I then read [WITNESS #2] and “Dustin” their Miranda rights and asked Jerry why he was pulling the tags off of the items. “Dustin” advised that [WITNESS #2] was wanting the items and she handed them to him to buy.

“Dustin” stated that he did not have the money so he pulled the tags off of the items so that he could get the items for [WITNESS #2]. I watched the video again and observed [WITNESS #2] and “Dustin” together with [WITNESS #2] walking ahead of “Dustin” while looking at their phone. There was no evidence that [WITNESS #2] was aware of “Dustin” stealing the items.

[WITNESS #1] then asked “Dustin” for his social security number so he could trespass “Dustin” in the Walmart system. The social that “Dustin” provided came back to a Jerry Patterson. I asked “Dustin” if his real name was Jerry which he advised it was. I asked Jerry who “Dustin” was which he advised that it was his brother.

I was provided a receipt with the items that Jerry had concealed and attempted to leave Walmart with. The receipt showed that Jerry concealed hook earrings ($3.88), car adapter ($8.98), Hanes bra ($17.68), and another Hanes bra ($17. 68) for a total of $51.60.

I then placed Jerry under arrest and escorted him to my patrol car. I searched Jerry’s person in front of my in car patrol camera and secured him in the back seat. I transported Jerry to the Whitfield County Jail where he was turned over to the Whitfield County booking staff.

Jerry was arrested on WA# 65668 for:

  • 16-8-14; theft by shoplifting (M)
  • 16-10-25; false name and date of birth (M)
