On May 26, 2022 Deputy Smith was dispatched to [300 BLOCK] Bethel Church Rd. in reference to domestic dispute. Upon arrival, Deputy Smith spoke with [VICTIM #1] who provided the information below.
[VICTIM #1] stated that he had gotten up and was getting ready for a doctor’s appointment. [VICTIM #1] stated that he went into the kitchen to cook breakfast and have a cup of coffee. He advised that his step son, Manuel Montiel was in the kitchen warming up a cup of coffee in the microwave.
[VICTIM #1] stated that he told Manuel to move out of the way, which made Manuel angry and they began to argue. [VICTIM #1] stated that Manuel grabbed his cup of coffee and threw it at him. He advised that when Manuel threw the coffee mug, it hit him in the left side of his face around his temple, which caused a laceration about 2 inches long and heavy bleeding.
[VICTIM #1] stated that when he was hit with the coffee mug, it caused him to fall to the ground. [VICTIM #1] stated that while he was on the ground, Manuel got on top on him and began trying to punch him. He stated that he dodged most of the punches other then a few that hit him in his left elbow. [VICTIM #1] stated that after this he got up and went to the porch and contacted 911.
After speaking with [VICTIM #1] Deputy Smith went into the residence to speak with Manuel. Manuel stated that when he had got up, he went into the kitchen to make him some coffee. Manuel stated that while warming up his coffee, [VICTIM #1] told him to move which made him angry. Manuel stated that he told [VICTIM #1] to say please and they began to argue. Manuel advised he then threw his coffee mug at [VICTIM #1] and hit him in the head with it.
After speaking with Manuel, Deputy Smith spoke with [WITNESS #1] which is Manuel’s mother and [VICTIM #1]’s wife. [WITNESS #1] stated that she witnessed the entire fight. [WITNESS #1] stated that her son was making a cup and coffee and [VICTIM #1] came in the kitchen and told him to move out of the way. [WITNESS #1] stated Manuel then told [VICTIM #1] to say please for him to move.
[WITNESS #1] stated that while Manuel and [VICTIM #1] were arguing, she was in the middle of them trying to separate them. [WITNESS #1] stated that Manuel then threw a coffee mug and it hit [VICTIM #1], resulting in him falling to the ground. [WITNESS #1] stated that once he fell Manuel got on top of [VICTIM #1]. She advised that she tried to get Manuel off of [VICTIM #1] and stop them from fighting but she wasn’t strong enough to do so.
Deputy Smith placed Manuel under arrest and charged him with O.C.G.A 16-5-23.1 Battery Family Violence on warrantless arrest #65742. Deputy Smith checked for tightness and double lock on the cuffs. Manuel was then transported to Whitfield County Sheriff’s Offices and turned over to Booking staff without incident.
[VICTIM #1] refused EMS while on scene and advised he was going to transport himself to Hamilton Medical Center.
