On 03/03/2022, around 2105 hours, I was extra patrolling the area of Providence Ministries located at 711 S. Hamilton St when I encountered an unidentified male asleep in front of the closed business.
I approached the male, who was later identified as Robert Stokes and informed him to wake up. After yelling several times, I was able to wake him up. I asked Robert why he was sleeping in front of a closed business. Robert stated that he is homeless and has no other place to sleep. After further investigation, I learned that Robert was banned from Providence Ministries on 12/29/2021 for sleeping in front of the property (case 21-007850).
I instructed Robert to stand up and turn around, which he did so. I placed handcuffs on Robert and double locked them. I escorted Robert to my patrol vehicle, where he was searched. After nothing of significance was founded on his person, I placed him inside my patrol vehicle, where he denied being secured by the seat belt. When asked if Robert was a US citizen, he stated, “no, he was Mexican” and denied me notifying the Mexican consulate of his arrest.
I transported Robert to the Whitfield County Jail, where he was charged with OCGA 16-7-21 criminal trespass and OCGA 16-11-36 loitering on warrantless arrest form #65453. Custody of Robert was turned over to the Whitfield County Jail.
I took no further action.
