On 05/22/22 at 2039 I was traveling east on Mlk Jr Blvd and observed a motor vehicle collision at Mlk Jr Blvd & N Easterling St. I observed a brown passenger car, [REDACTED BY AGENCY], traveling north on N Easterling and enter the intersection. The vehicle struck another passenger car, [REDACTED BY AGENCY].

I had both vehicles pull over out of the roadway. I made contact with vehicle 1 ([REDACTED BY AGENCY]). The driver, Shelby, immediately began to explain that she did not see the other vehicle.

I could detect a strong odor of marijuana coming from Shelby’s vehicle. When Shelby and her passenger, [REDACTED], exited the vehicle I could still detect the odor coming from them. Shelby also moved and spoke at a slow pace.

I asked for another unit and began to work the collision. See gears report from more information. I gave the other driver, [REDACTED], a business card with a case number and released him.

I asked Shelby when she last smoked marijuana. She stated that she had smoked a few hours prior. Shelby acted very strange and had glossy eyes. I asked Shelby if she would be willing to do some field sobriety tests for me. She stated that she would be willing to take the tests.

Officer Morang arrived on scene and conducted field sobriety and drug recognition tests on Shelby. See Officer Morang’s supplemental for more information on his findings. Officer Morang advised that he would make an arrest in this situation due to her impairment.

Due to the driving that I observed, the odor of marijuana and Shelby’s admission to smoking roughly 3 hours prior to my contact I determined that Shelby was impaired to the extent that she was unsafe to operate her vehicle.

I arrested Shelby. I handcuffed her, searched her, and secured her in my patrol vehicle. I read her implied consent and she consented to a test of her urine. I transported her to the Whitfield County Jail.

The vehicle was released to the registered owner.

Jail staff, [REDACTED], collected the urine sample from Shelby. I charged Shelby with DUI less safe drugs, failure to yield and driving without a license.

The urine test kit was entered into property and evidence.
