On 6-1-22 Deputy Townsend and Sgt. Buchanan met with Mr. [VICTIM #1] at 877 Reed Pond Rd. (C&S Grocery) in reference to a theft.

Mr. [VICTIM #1] stated that he was at the store around 1200 hrs and that he went inside to get something to drink and played the gaming machines. Mr. [VICTIM #1] stated that when he left the store he went to another location and realized that he did not have is phone. Mr. [VICTIM #1] stated when he went back to the store he could not locate his phone. Mr. [VICTIM #1] stated that he back tracked to where he was at earlier that morning and still could not locate the phone.

Mr. [VICTIM #1] stated he then contacted a friend and used a tracking app to locate the phone. Mr. [VICTIM #1] stated that the phone was showing to be near the dead end of Bergman Way. While speaking with Mr. [VICTIM #1], the phone moved down Bergman Way near Reed Pond Rd. At the same time the phone moved, there was a female (Ms. Kelley) seen walking down Bergman Way.

Deputies relocated over to where Ms. Kelley was and began speaking with her about the incident. Ms. Kelley stated that she was advised by a friend ([REDACTED]) that he had left his phone on one of the gaming machines at the store. Ms. Kelley was unable to provide any other information for [REDACTED] other than his first name. Ms. Kelley stated that when she went to the store, she located a phone on one of the machines.

Ms. Kelley stated described the phone as being a newer phone and that it either had a black or clear case on it. Ms. Kelley stated that when she located the phone she gave it back to [REDACTED]. Ms. Kelley stated that [REDACTED] told her that the phone was not his and that he kept the phone. Ms. Kelley stated that she thought [REDACTED] would take the phone back to the store because it was not his.

While speaking with Ms. Kelley, Deputy Townsend asked for consent to search her purse, Ms. Kelley gave consent. During the search, Deputy Townsend located a pill bottle which contained a crystal like substance believed to be Methamphetamine. At that time Ms. Kelley was placed in handcuffs and detained.

Deputy Townsend spoke with the on call Narcotics Investigator (Sgt. Spurlock) and advised him of the situation, Sgt. Spurlock advised that he would be enroute.

Deputy Townsend spoke with the store clerk who advised that no one had turned a phone in to her. The clerk stated that the store had video cameras but the owner was the only one that could view them and that she was on vacation.

Upon completion of the investigation, Ms. Kelley was advised that she was under arrest and then transported to the Whitfield County Detention Center. See Sgt. Spurlock’s supplemental for additional information.

The evidence located in Ms. Kelley’s purse was turned over to Sgt. Spurlock. This case will be left active pending further investigation.
