I was dispatched to [2400 BLOCK] Nesmith Road in reference to a report of a dispute between [VICTIM #1] and 2 unknown individuals. I arrived on scene and located 2 males walking through the yard. One of the males, later identified as Christopher Soto, was holding a black in color AR-15 and a black in color handgun. I instructed Soto to drop the weapons which he did. I escorted the males to the front of my patrol car where I was able to secure the firearms in the back seat.
When Deputy Smith arrived on scene, I was able to run the firearms through dispatch which showed “no record” on both. The first firearm was a Springfield XD (SN: GM424836) chambered in .45 caliber and the second was an American Tactical AR-15 (SN087776) chambered in .223.
I returned to Soto and asked him to explain to me what occurred while Deputy Smith spoke with [VICTIM #1]. Soto originally stated he wished I would speak with [VICTIM #1], because he did not call for law enforcement assistance. After several minutes, Soto stated an argument began due to him possibly calling [VICTIM #1]’s son, [WITNESS #1], “a b*tch for not being tough”. He stated [VICTIM #1] became upset and pushed him twice, causing him to fall onto his back each time. Soto stated he returned to his feet and slapped [VICTIM #1]’s face with an open hand. I asked him if anyone else was present during the incident. Soto stated only him and [VICTIM #1] were in the room at the time.
When Deputy Smith returned, I asked him again if anyone was present, to which he stated his brother and sister-in-law were in the living room during the incident but will not take his side.
I spoke with [VICTIM #1] who stated Soto called [WITNESS #1] “a b*tch” and when she confronted him regarding the issue an argument began. She stated during the argument, Soto slapped her face which caused her left eyebrow to bleed. I asked her if she knew when Soto grabbed the firearms to which she stated she did not know he did.
I spoke with [WITNESS #1] who gave the same recap as [VICTIM #1] of the incident. He stated Soto called him “a b*tch” and [VICTIM #1] became upset. He stated he did not see Soto get pushed to the ground during the argument but knew his mother had been slapped. He stated during the argument, he left the residence to prevent him from being involved. While outside of the residence, [WITNESS #1] was able to call 911.
I determined Soto did commit the offenses of disorderly conduct for profanity in front of a child and Battery (FVA) due to both parties living together.
Soto was placed under arrest and transported to the jail without incident. Warrants will be issued for Disorderly Conduct and Battery (FVA).
