By downloading or using the The Georgia Gazette app or website (the “Service”), these terms automatically apply to you — please read them carefully before using the Service.

1. Eligibility & Acceptance

You must be the age required by your jurisdiction and by your app store’s rating to use the Service. By creating an account or using the Service, you agree to these Terms of Use. The app contains mature content (including crime and arrest information) and is intended for older audiences consistent with its app-store age rating.

2. Intellectual Property & License

You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to The Georgia Gazette, LLC. We grant you a personal, non-transferable, revocable license to use the app for its intended purpose, subject to these terms.

3. Your Account

You are responsible for the activity on your account and for keeping your login credentials and device secure. We recommend you do not jailbreak or root your phone — that removes security restrictions imposed by your device’s operating system, could make your phone vulnerable to malware, and could mean the app won’t work properly.

4. User Content & Community Standards

The app lets you post comments, votes, replies, and mentions (“User Content”). You are solely responsible for the User Content you post, and you retain ownership of it. By posting, you grant The Georgia Gazette, LLC a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content within the Service to operate it.

There is zero tolerance for objectionable content and abusive users. You agree not to post content that:

  • harasses, bullies, threatens, or defames any person;
  • contains hate speech or attacks people based on protected characteristics;
  • is sexually explicit, obscene, or harmful to minors;
  • is spam, a scam, or otherwise unlawful; or
  • infringes anyone’s intellectual property or privacy rights.

You can report any post or comment and block any user from within the app. We review reports and act on violating content — typically within 24 hours — and we may remove content and warn, suspend, or permanently ban users at our discretion. We are not obligated to monitor User Content but may do so.

5. News & Public-Records Content

News, arrest, and booking content is provided for informational purposes and is sourced from TheGeorgiaGazette.com and third-party public records. An arrest or booking is not a conviction, and all persons are presumed innocent unless and until proven guilty. We endeavor to keep information updated and correct, but we rely on third parties to provide it and do not guarantee its accuracy, completeness, or timeliness, and accept no liability for any loss, direct or indirect, arising from reliance on it. To request a correction or removal of a news item, contact us at the address below or via our Removal Request page.

6. Account & Content Deletion

You may permanently delete your account and associated content at any time from within the app (Settings → Account → Delete account), or by contacting us. Deletion is permanent and cannot be undone.

7. Changes & Charges to the Service

The Georgia Gazette, LLC is committed to ensuring the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services at any time and for any reason. We will never charge you for the app or its services without making it very clear exactly what you’re paying for.

8. Third-Party Services

The app uses third-party services that declare their own terms and conditions, including:

  • Apple Push Notification service and Google Firebase Cloud Messaging (via Expo) — delivery of push notifications
  • Brevo — delivery of notification and account emails

Your use of these providers is governed by their respective terms and privacy policies.

9. Connectivity, Charges & Your Responsibilities

Certain functions of the app require an active internet connection (Wi-Fi or mobile data). The Georgia Gazette, LLC cannot take responsibility for the app not working at full functionality if you don’t have Wi-Fi access or remaining data allowance.

If you’re using the app outside of a Wi-Fi area, the terms of your mobile network provider still apply, and you may be charged for data, including roaming charges if you use the app outside your home territory without turning off data roaming. In using the app, you accept responsibility for any such charges. If you are not the bill payer, we assume you have permission from the bill payer to use the app. Likewise, you are responsible for keeping your device charged to access the Service.

10. Updates & Termination

The app is currently available on Android and iOS; the requirements for these systems (and any others we extend to) may change, and you’ll need to download updates if you want to keep using the app. We do not promise to always update the app or that it will work with the OS version installed on your device, and you agree to accept updates when offered. We may also stop providing the app and may terminate your use of it at any time without notice. Upon termination, (a) the rights and licenses granted to you in these terms will end, and (b) you must stop using the app and, if needed, delete it from your device.

11. Disclaimers & Limitation of Liability

THE SERVICE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE GEORGIA GAZETTE, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

12. Governing Law

These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules.

13. Changes to These Terms

We may update these Terms from time to time. You are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms on this page. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
