On 05/29/2023 at approximately 0128 while logging a check of North Side Baptist Church 1001 North Jefferson Street on routine patrol in the area of North Jefferson Street. I heard what I believed to be fireworks. Due to where I was sitting in the parking lot, I was unable to see the intersection of North Jefferson and Martin Luther King Jr Drive.
Shortly after hearing that, I observed a red Nissan Altima traveling north away from the area at a high rate of speed. I pulled out of the parking lot from the northern most exit on Jefferson Street. As I was attempting to give the tag to dispatch, I observed the vehicle accelerate at a high rate of speed away from my vehicle. I activated my emergency equipment and began to attempt to conduct a traffic stop. The vehicle came to a stop north of Ivey Weaver Road. Once I stopped the vehicle, I called the driver, later identified as [REDACTED BY AGENCY] [VICTIM #1], to come back to my vehicle. The other occupants of the vehicle were later identified as [VICTIM #2], [REDACTED BY AGENCY] [VICTIM #3], [VICTIM #4] and [REDACTED BY AGENCY] [[VICTIM #5]].
I began speaking with [VICTIM #1] about why he was driving in the manner that he was. [VICTIM #1] stated that he had just been shot at near the intersection. Still believing what I had heard was fireworks, I advised him that individuals had been shooting fireworks most of the night near that area. A short time later I walked to the passenger side of the vehicle and discovered the vehicle had indeed been struck by gun fire. I asked the other occupants out of the vehicle to ensure no one was hurt and also to secure the scene. I advised dispatch and other officers of the situation and asked for units to go to the area in an attempt to locate any casings. A short time later Officer Webb advised me he had located five 9 mm shell casings in the roadway. Officer Webb collected the shell casings and turned them over to me. I placed the shell casings into evidence locker #5.
I made contact with [VICTIM #1] who stated while at the Waffle House 1683 North Columbia Street an unknown person approached him and stated “y’all don’t belong here”. [VICTIM #1] stated he then left the parking lot. [VICTIM #1] stated after turning east onto Martin Luther King he noticed a black Hyundai following him. [VICTIM #1] stated as he approached the intersection of MLK and Jefferson Street he heard approximately five gunshots.
I asked [VICTIM #1] if he could describe the individual that approached him, but he stated he had never seen him before. When I began to ask more questions about where the exchange of words took place at [VICTIM #1] stated he was parked in front of the Hop-In gas station.
Lieutenant Chapple notified Detective Mcleroy. Upon his arrival, the scene was turned over to him for further investigation.
