I was dispatched to the area of Highway 212 and Little Road in reference to a road rage incident involving a firearm. Dispatch advised me that an older white male driving a dark green Dodge truck with a ladder rack had pulled a silver revolver on another motorist. Utilizing Flock cameras, I was able to locate and identify the vehicle involved. The vehicle, a 1998 Dodge Dakota bearing Georgia tag [REDACTED], was registered to Terence Percival at [100 BLOCK] Merry Drive. Prior to my arrival in the area, dispatch advised me that the Dodge Dakota had turned onto Little Road.
I made contact with the complainant, [VICTIM #1], who had stopped at the Jet Store located at 799 Georgia Highway 212. [VICTIM #1] stated that as he was driving south on Highway 212, he attempted to pass the Dodge Dakota, which was traveling below the speed limit. [VICTIM #1] stated that as he began to pass the Dodge Dakota, the older white male driver, who was wearing a black cowboy hat, began gesturing at him with his middle finger. [VICTIM #1] stated the male then pulled out a silver revolver with a wooden handle and pointed the firearm at [VICTIM #1]. [VICTIM #1] stated he feared the driver was going to shoot him, so he sped off.
Lieutenant Goddard, Sergeant Robinson, and I relocated to [100 BLOCK] Merry Drive and made contact with Percival, who was standing in the driveway wearing a black cowboy hat and had a holster containing a silver revolver with a wooden handle on his right hip. I asked Percival the open-ended question of what happened when he was driving home on Highway 212. Percival stated the vehicle behind him had been tailgating him, so he slowed down in an attempt to get the vehicle to back off. Percival then stated he never pointed a gun at anyone.
I asked Percival why he would say that, as I made no mention of a weapon being involved. Percival again said he didn’t point a gun at anyone. Percival then said the vehicle attempted to pass him, which upset him. Percival admitted to cussing at the driver, flipping him off, and eventually retrieving his Smith & Wesson .357 revolver. Percival stated he pointed the firearm straight ahead so the other driver could see it but denied pointing it directly at the driver.
While speaking with Percival, I detected the odor of an alcoholic beverage coming from his person. Percival admitted to drinking a few beers within the past hour prior to driving. I informed Percival he was going to be placed under arrest for the firearm incident. I read Percival his Miranda Rights and the Georgia Implied Consent Notice for suspects age 21 or over. Percival agreed to provide a breath sample once we arrived at the jail. I placed Percival in handcuffs behind his back and escorted him to the back seat of my patrol car.
I transported Percival to the jail and conducted a test on the Intoxilyzer 9000. Percival successfully provided two breath samples, resulting in a BAC of 0.038. Percival was turned over to jail staff and charged with aggravated assault. I secured the Smith & Wesson .357 revolver in evidence and completed a property/evidence receipt form.
A warrant for aggravated assault was secured.
