On August 30, 2025, Deputy Schuster, responded to the Banks County Sheriff’s Office in reference to a walk-in report. On-call CID was notified and responded to the Sheriff’s Office. Report taken and turned over to CID for further.

On scene, I met with [REDACTED BY AGENCY], their daughter, [REDACTED BY AGENCY] and, [REDACTED BY AGENCY] aunt, [REDACTED BY AGENCY]. [REDACTED BY AGENCY] stated [REDACTED BY AGENCY] currently lives out of stated but returned for some time so [REDACTED BY AGENCY] went to visit him at [REDACTED BY AGENCY] in Baldwin. [REDACTED BY AGENCY] stated while [REDACTED BY AGENCY] was there, they found out that she had left the residence with an 18 year old male and had sex. [REDACTED BY AGENCY] stated [REDACTED BY AGENCY] is 14 years old. [REDACTED BY AGENCY] stated she was at her residence in Toccoa and did not know of this until she was called about it and advised [REDACTED BY AGENCY] would have to explain what happened.

I first asked [REDACTED BY AGENCY] if having sex was something that she wanted. [REDACTED BY AGENCY] was silent at first so I rephrased my question to ask if she felt coerced or pressured to have sex. [REDACTED BY AGENCY] stated no. I asked [REDACTED BY AGENCY] when the incident occurred. [REDACTED BY AGENCY] stated it was the middle of the night last night. [REDACTED BY AGENCY] stated the male, who she only knew as Antonio, had asked to her meet however she could not because her parents said no to her leaving the house.

Later in the night, [REDACTED BY AGENCY] stated she asked Antonio to bring her salsa. Antonio told [REDACTED BY AGENCY] he would however he advised her he would need something in return for it. [REDACTED BY AGENCY] stated he drove to the residence and when he got there, she snuck out of the house to meet him. [REDACTED BY AGENCY] stated she had him park close to the wood line so he would not be seen. [REDACTED BY AGENCY] stated she walked to the driver’s side window and Antonio told her the salsa was in the passenger seat and that she should get in the car. [REDACTED BY AGENCY] stated she got in the car and they began to kiss. [REDACTED BY AGENCY] stated she told Antonio she needed to get back inside before she gets in trouble. [REDACTED BY AGENCY] stated Antonio then asked her to get in the back seat for a few minutes and that is when they had sex. [REDACTED BY AGENCY] stated, “It just happened,” when speaking about sex.

I asked [REDACTED BY AGENCY] how she knew Antonio. [REDACTED BY AGENCY] stated she saw Antonio on her friend’s brother’s SnapChat and added him from there. [REDACTED BY AGENCY] stated they have been talking for the last 2 months. [REDACTED BY AGENCY] is able to provide me with Antonio’s SnapChat [REDACTED BY AGENCY] as well as his phone number. [REDACTED BY AGENCY] stated they have only communicated through SnapChat and FaceTime. [REDACTED BY AGENCY] stated last night was the first night they had met in person. [REDACTED BY AGENCY] stated Antonio is 18 and is in college but unsure of where. [REDACTED BY AGENCY] stated she does know Antonio plays baseball. [REDACTED BY AGENCY] did show me a photo of Antonio that he had posted to his SnapChat profile.

[REDACTED BY AGENCY] father, [REDACTED BY AGENCY] stated he spoke with Antonio over the phone after finding out what had occurred and Antonio was not forthcoming with information. [REDACTED BY AGENCY] stated Antonio had stated he did not know [REDACTED BY AGENCY] age however does not believe that to be true.

On-call CID was notified and Investigator Way responded to the Sheriff’s Office. Investigator Way spoke with [REDACTED BY AGENCY] and her parents. Investigator Way then escorted [REDACTED BY AGENCY] and her family to the PowerHouse in Toccoa.

Through Flock Safety, I was able to locate a vehicle matching the description [REDACTED BY AGENCY] gave. A white in color 2020 Mercedes Benz with Georgia tag [REDACTED BY AGENCY] returned to an [REDACTED] of Flowery Branch. The male the vehicle is registered was not the male [REDACTED BY AGENCY] had met with however is assumed to be his father. After locating the vehicle and searching social media, I was able to identify Antonio De La Torre Mariscal as the male [REDACTED BY AGENCY] had met with. Antonio is currently a student at [REDACTED BY AGENCY] and plays baseball there.
