Officer’s Narrative:

On 11/27/2025 Cpl. Burnette responded to [400 BLOCK] Rattle Trap Rd. in reference to a welfare check with Cpl. Pressley and Deputy Mote’s. [REDACTED BY AGENCY] had called Banks County Dispatch and asked for the welfare check due to receiving information that [REDACTED BY AGENCY] was in trouble. [REDACTED BY AGENCY] stated that [REDACTED BY AGENCY] had text her stating that she had been beaten by [REDACTED BY AGENCY] Brandon Laymon and he was threatening to kill and rape her.
Cpl. Burnette and Cpl. Pressley arrived on scene and began attempting to contact anyone at the residence of [400 BLOCK] Rattle Trap Rd. Multiple attempts were made at the front door with no contact. Cpl. Burnette noticed there was a window AC unit running and used his flashlight to knock on the side of the trailer while announcing Sheriff’s Office.
Cpl. Burnette could hear movement inside the residence and began moving to the back of the residence in case someone attempted to flee out of the back. Cpl. Burnette ended up contacting [REDACTED BY AGENCY] at the back door. During this time, deputies could still hear movement inside the residence. [REDACTED BY AGENCY] stated that it was just her dogs inside a built-on addition.
Cpl. Burnette asked [REDACTED BY AGENCY] what was going on and [REDACTED BY AGENCY] stated that her and [REDACTED BY AGENCY] Brandon had gotten into a verbal altercation earlier in the night and Brandon had left the residence. When asked where he went, [REDACTED BY AGENCY] couldn’t tell deputies besides someone must have came to pick him up due to him not having a vehicle that was operational.
Deputies could still hear movement which was not the same movement as the dogs inside the kennels in the addition. Cpl. Burnette asked [REDACTED BY AGENCY] if she was hurt due to the information given by [REDACTED BY AGENCY] to dispatch. [REDACTED BY AGENCY] stated that [REDACTED BY AGENCY] worries about her a lot.
Cpl. Burnette noticed that during this time, [REDACTED BY AGENCY] was hiding her hand under her arms and across her body along with raising her shoulders up to cover her neck area. Cpl. Burnette and Cpl. Pressley asked consent to check inside the residence due to believing Brandon was still on scene. [REDACTED BY AGENCY] gave consent and never revoked the consent.
Brandon was observed in what appeared to be hiding inside the bathroom within the primary bedroom. Brandon was taken into custody and placed in handcuffs. Brandon was advised that he was not under arrest, but he was being detained until deputies determined what had happened. Brandon was then taken outside where he stood with Deputy Motes.
Cpl. Burnette reentered the residence and asked [REDACTED BY AGENCY] why she would lie about Brandon being inside the residence. [REDACTED BY AGENCY] stated I know, I didn’t want this sh*t to happen. At this time, [REDACTED BY AGENCY] father arrived on scene. When asked how he knew about the incident, it was determined that [REDACTED BY AGENCY] had called [REDACTED BY AGENCY] father about the incident along with 911.
When asked about getting down to the information at hand and why [REDACTED BY AGENCY] was not being forthcoming with deputies, [REDACTED BY AGENCY] father stated because Brandon stated he would kill her. The statement from the dad who arrived on scene is the same information deputies received about the incident as well.
It also should be noted that in a lot of domestic violence cases, the victim feels responsible to the offender being arrested or losing the sense of false security that the offender promises them. This is why a lot of victims do not want to speak with deputies or law enforcement about domestic violence related incidents.
When asked to tell the truth about what happened, [REDACTED BY AGENCY] stated that her and Brandon were in a verbal argument. [REDACTED BY AGENCY] stated that she and Brandon argue all the time and she did not want Brandon to go to jail. Cpl. Burnette informed [REDACTED BY AGENCY] that in family violence cases, she doesn’t have to prosecute, but the State of Georgia will prosecute based on the incident. Cpl. Burnette informed [REDACTED BY AGENCY] that the main thing is her safety.
Cpl. Burnette also advised [REDACTED BY AGENCY] that hiding him inside the residence puts deputies in a bad spot due to potential ambush-style attacks. Cpl. Burnette then asked [REDACTED BY AGENCY] the direct question of “Did he make threats to you?” [REDACTED BY AGENCY] responded with “do I have to answer that”. Cpl. Burnette informed [REDACTED BY AGENCY] that she didn’t have to answer, but he would like her to answer the question. [REDACTED BY AGENCY] asked to use the bathroom and at this time did not answer the question.
Cpl. Burnette left the inside of the residence and spoke with Brandon. Cpl. Burnette read Brandon his Miranda Warning and Brandon stated that he did not really want to talk with deputies about the incident. Cpl. Burnette advised Brandon that it’s his right to not speak and Brandon was placed inside Deputy Motes patrol car while Cpl. Burnette continued the investigation.
Cpl. Burnette believed based on the hesitant nature of [REDACTED BY AGENCY] speaking with deputies, [REDACTED BY AGENCY] and father both stating that they are aware of domestic violence incidents involving the two, and the information relayed by dispatch, Cpl. Burnette believed that Brandon had committed a crime involving at minimum simple assault due to the totality of circumstances available to deputies at this time.
Cpl. Burnette went back to the residence and sat down to speak with [REDACTED BY AGENCY] who was sitting on the couch in the living room. Cpl. Burnette advised [REDACTED BY AGENCY] of what he already knew. Cpl. Burnette advised [REDACTED BY AGENCY] that he knew that she called [REDACTED BY AGENCY] around 3 am. [REDACTED BY AGENCY] then called 911 and stated some specific things. Things only someone with direct knowledge would tell her those things.
Cpl. Burnette advised [REDACTED BY AGENCY] that usually when domestic violence starts, 9 times out of 10 it doesn’t stop. It continues to progress and threats become actions. Cpl. Burnette advised [REDACTED BY AGENCY] that everyone has a place where they feel safe and it’s usually their residence. Cpl. Burnette then asked [REDACTED BY AGENCY] if she felt safe in her safe space. [REDACTED BY AGENCY] stated no.
[REDACTED BY AGENCY] stated that the argument started at 2 am and lasted until 5. At 2 am [REDACTED BY AGENCY] stated she told Brandon to get out of the residence because all he does is lie to her. [REDACTED BY AGENCY] stated her and Brandon got into a verbal argument and that she told him to leave. Brandon had gone outside and [REDACTED BY AGENCY] stated she wouldn’t let him come back inside the residence.
[REDACTED BY AGENCY] then stated Brandon pushed her out of the way to get back inside the residence. [REDACTED BY AGENCY] stated she told Brandon not to put his hands on her. Brandon responded with calling her names such as sl*t and everything else. [REDACTED BY AGENCY] stated she said she went into the bedroom to go to sleep and told Brandon that when she woke up, he needed to have left.
[REDACTED BY AGENCY] then stated Brandon stated oh you’re not doing anything. [REDACTED BY AGENCY] then stated Brandon then began putting his hands on her. Cpl. Burnette asked [REDACTED BY AGENCY] to be specific about her response because putting hands on someone can be interpreted differently by different people. [REDACTED BY AGENCY] then stated, “I’m assuming he is going to jail”.
Cpl. Burnette advised [REDACTED BY AGENCY] that the purpose of the conversation was to get the truth out. [REDACTED BY AGENCY] stated if Brandon goes to jail, then her life will be bad when he gets out. When informed that protective measures can be put into place, [REDACTED BY AGENCY] stated it’s just a piece of paper.
[REDACTED BY AGENCY] then stated that Brandon took her phone at 2 am and didn’t give it back until 5 am. [REDACTED BY AGENCY] asked how is she supposed to call for help when he takes her phone? [REDACTED BY AGENCY] then stated Brandon wouldn’t let her out of the bedroom. When asked what she meant. [REDACTED BY AGENCY] stated that Brandon wouldn’t let her leave the bedroom for anything.
[REDACTED BY AGENCY] then stated during the conversation that Brandon hit her. Cpl. Burnette asked [REDACTED BY AGENCY] what she meant by Brandon hit her. Cpl. Burnette informed [REDACTED BY AGENCY] that based on the testimony that’s already been given was enough to take Brandon to jail. Cpl. Burnette advised [REDACTED BY AGENCY] that the purpose of speaking was about her protection and keeping her safe.
[REDACTED BY AGENCY] stated it started by him accusing her of taking his phone and truck keys. [REDACTED BY AGENCY] stated she was trying to record for evidence when Brandon snatched the phone out of her hand. [REDACTED BY AGENCY] checked and the recording was not found.
Cpl. Burnette noticed that [REDACTED BY AGENCY] had some visible marks on the left side of her neck. Cpl. Burnette asked [REDACTED BY AGENCY] what happened to her neck. [REDACTED BY AGENCY] stated that Brandon had choked her in the bedroom and bathroom. Cpl. Burnete asked [REDACTED BY AGENCY] to tell him about that.
[REDACTED BY AGENCY] stated Brandon grabbed her by her throat and started choking her. Brandon then threw her down on the bed. [REDACTED BY AGENCY] then reverted to not wanting him to go to jail due to fear of retaliation. Cpl. Burnette advised [REDACTED BY AGENCY] that there are programs that can help her with the domestic violence. Cpl. Burnette also advised [REDACTED BY AGENCY] that the most important thing is her safety.
- Waking up or staying alive and
- Breaking the cycle of domestic violence.
Cpl. Burnette advised her that those marks on her neck don’t just happen by a little force. [REDACTED BY AGENCY] stated I know. Cpl. Burnette then pointed out injuries to her wrist, arms, and neck. [REDACTED BY AGENCY] then asked if there was a knot on her forehead. Cpl. Pressley and Cpl. Burnette observed a knot on the center of [REDACTED BY AGENCY] forehead. [REDACTED BY AGENCY] then stated her nose was bleeding earlier from where Brandon headbutted her.
Cpl. Burnette then began to revisit the statements made so far in the interview.
1 – [REDACTED BY AGENCY] asked him to leave.
2 – Brandon went outside and [REDACTED BY AGENCY] tried to keep him from coming back inside.
3 – Brandon forced his way back inside the residence (pushed [REDACTED BY AGENCY] to get back inside the residence).
4 – They were in an argument in the bedroom.
5 – [REDACTED BY AGENCY] was attempting to record the incident when Brandon took the phone and wouldn’t give it back.
Cpl. Burnette asked [REDACTED BY AGENCY] to pick up from there and continue telling him what happened. [REDACTED BY AGENCY] stated she told Brandon to give her the phone back and Brandon refused to give the phone back. [REDACTED BY AGENCY] then stated that Brandon does this thing where he goes to hug her but pulls up on her neck which she felt a pop and she began crying.
[REDACTED BY AGENCY] then stated that Brandon stopped for a moment and then he hit her on the back of the head. [REDACTED BY AGENCY] stated Brandon began calling her names such as wh*re, sl*t, fat and other names. [REDACTED BY AGENCY] asked Brandon if she could just go to the bathroom. After [REDACTED BY AGENCY] went to the bathroom, Brandon wouldn’t let her out of the bathroom. [REDACTED BY AGENCY] then stated Brandon pushed her back into the sink and continued verbally degrading her.
[REDACTED BY AGENCY] stated that she didn’t remember exactly how she ended up on the floor, but Brandon grabbed her by her throat and she wound up on the floor. [REDACTED BY AGENCY] then stated Brandon physically banged her head off the floor. [REDACTED BY AGENCY] then stated she was going to give a back story which was that she had relations with another man while Brandon was previously in jail.
[REDACTED BY AGENCY] then stated Brandon pulled his pants down and without saying he was going to rape her, stated he was going to do that. [REDACTED BY AGENCY] then stated she didn’t remember exactly what Brandon said but it was something along the line of “you fu*ked [REDACTED BY AGENCY], so you’re going to do me the same way”.
[REDACTED BY AGENCY] then stated she just laid there because she was on the floor and Brandon took his pants off. [REDACTED BY AGENCY] then stated Brandon then pulled her up from the ground, spun her around where she was against the bed. [REDACTED BY AGENCY] then stated Brandon then grabbed her by the neck choking her and forced her on the bed.
Once on top of the bed, Brandon grabbed a pillow and put it over her face attempting to smother her. [REDACTED BY AGENCY] stated that she began trying to get the pillow off her face and Brandon grabbed her hands and bent them back causing her to cry in pain while asking Brandon to stop. [REDACTED BY AGENCY] then stated that Brandon stated “no bit*h, this is what you deserve”.
[REDACTED BY AGENCY] then stated that this was ongoing from 2am to 5 am when she text [REDACTED BY AGENCY] about the incident. Cpl. Burnette asked [REDACTED BY AGENCY] if Brandon had penetrated or sexually assaulted her. [REDACTED BY AGENCY] stated no, but Brandon stated he was going to.
[REDACTED BY AGENCY] then stated Brandon yanked her up off the bed as she was begging him to stop. [REDACTED BY AGENCY] stated she was sliding down the side of the bed when Brandon began choking her again. While choking her, [REDACTED BY AGENCY] stated Brandon began degrading her again and asked [REDACTED BY AGENCY] why she did those things to him [REDACTED BY AGENCY] believes he is referring to the affair with [REDACTED BY AGENCY].
[REDACTED BY AGENCY] stated she kept telling him that she didn’t know why and when she gave that answer, Brandon became more upset. [REDACTED BY AGENCY] then stated that Brandon told her that she better not tell anyone about the incident or he would kill her.
[REDACTED BY AGENCY] stated that she asked Brandon for her phone back because she felt like she needed medical attention due to her neck hurting from Injuries caused by Brandon. [REDACTED BY AGENCY] then stated Brandon refused to give her phone back to her and stated that he knew what would happen if she got her phone back. [REDACTED BY AGENCY] stated that Brandon stated that he would be in jail if [REDACTED BY AGENCY] got her phone back.
[REDACTED BY AGENCY] stated that she stood there in front of the sink in the bathroom for approximately 1 hours while Brandon yelled at her. [REDACTED BY AGENCY] then stated Brandon raised her hand at her as if he was going to smack her. [REDACTED BY AGENCY] stated she told Brandon to do it. [REDACTED BY AGENCY] stated that Brandon stated no I got something for you. [REDACTED BY AGENCY] stated she didn’t know what that meant.
[REDACTED BY AGENCY] stated that she then sat on the bed where Brandon continued to pull her hair and smacked her in the back of the head multiple times for a duration of time. [REDACTED BY AGENCY] then stated Brandon stopped and then advised he wanted a hug. [REDACTED BY AGENCY] stated she didn’t want to fight with him anymore, so she hugged him even though she didn’t want to.
[REDACTED BY AGENCY] then stated that finally the fight stopped and she got her phone back. Once she got her phone back, she was able to text [REDACTED BY AGENCY] about the incident. [REDACTED BY AGENCY] then stated she deleted the messages from her phone so that Brandon wouldn’t find them, but [REDACTED BY AGENCY] could send them to show deputies.
Cpl. Burnette informed [REDACTED BY AGENCY] that the incident would be documented and the judicial process would take place. Cpl. Burnette advised [REDACTED BY AGENCY] that he cannot promise her the outcome of the incident and that the courts would make decision based on the information gathered. [REDACTED BY AGENCY] did state she didn’t want to write a statement. When asked why she did not want to write a statement, [REDACTED BY AGENCY] stated that the last time this happened, Brandon got upset with her and she just didn’t want to be put through that again.
[REDACTED BY AGENCY] did ask if deputies could get Brandon’s phone due to there being a potential video of the incident. Cpl. Burnette advised [REDACTED BY AGENCY] that a search warrant would have to be conducted to get that video if it’s on his phone. After the incident, Banks County EMS was contacted due to [REDACTED BY AGENCY] needing to be checked out. Banks County Investigators were also notified of the incident.
[REDACTED BY AGENCY] was transported to the hospital to seek treatment for her injuries sustained during the incident. Photos of the injuries and of the inside of the residence where the incident happened were obtained as well. Body camera was activated and recorded the interaction with all parties.
Based on the verbal testimony and physical marks on [REDACTED BY AGENCY], Cpl. Burnette charged Brandon with aggravated assault X2 (choking 3 separate times and the using a pillow to suffocate [REDACTED BY AGENCY] on the bed), False Imprisonment (not allowing her to leaving and keeping her in a certain plain against her will), and Battery (headbutting her causing redness to her nose, contusion to her forehead, marks on her wrist, arms, and neck). These all three are family violence related charges.
