On April 28th, 2026 at approximately 0051 hours, Deputy Hill was notified of a BOLO (Be On The Lookout) for a gray passenger car which is failing to maintain lane driving southbound on Interstate 85 from mile marker 153.

Deputy Hill awaited the vehicle at the base of the mile marker 149 south offramp. Deputy Hill notified dispatch to have the caller who was maintaining contact on the line to activate their hazard lights as they approached the exit. Deputy Hill later observed the callers blue Ram truck with their hazard lights active. Ahead of that vehicle, Deputy Hill observed a gray passenger car traveling in the left lane at a slow rate of speed which Deputy Hill visually estimated at approximately 40-50 miles per hour. Deputy Hill then observed the vehicle speed up rapidly, cross all lanes of traffic and enter the right-hand turn lane for the off ramp.

As the vehicle passed Deputy Hill it continued straight, drove over the hashed gore and nearly struck the guardrail. The vehicle then rapidly re-entered southbound Interstate 85 in front of a semi-truck nearly causing a collision. While it was passing him, Deputy Hill noted the vehicle was a gray Audi passenger car with a North Carolina tag. Deputy Hill entered the interstate and began to apprehend the vehicle. Just passed the overpass, Deputy Hill regained visual after passing multiple semi-trucks.

Deputy Hill noted the vehicle was swerving across two lanes and then began to split both lanes. Deputy Hill engaged his emergency equipment, and the vehicle initially didn’t appear to react to him. After a short time, the vehicle then began to slow and over to the right shoulder of the interstate near Tanger Outlets. Deputy Hill noted the Audi displayed a North Carolina tag [REDACTED BY AGENCY].

Deputy Hill made contact with he driver and sole occupant Jorden Schlossman (D1) who identified himself via his North Carolina driver’s license. Deputy Hill asked Schlossman if he was ok to which he stated he was. Schlossman stated he was driving from Charlotte North Carolina. Deputy Hill advised Schlossman that he was failing to maintain his lane and asked why to which he remained silent and articulated his phone.

Deputy Hill noted Schlossman’s demeanor was sluggish in nature, and he appeared to not want to look at Deputy Hill. Deputy Hill noted a pungent odor consistent with an alcoholic beverage emanating from the interior of the vehicle. Deputy Hill also observed Schlossman’s eyes were mildly bloodshot and were glossy / watery.

Deputy Hill asked if Schlossman had been drinking and he stated he had not. Deputy Hill asked Schlossman why he was smelling an odor consistent with alcohol and he remained silent. Deputy Hill informed him his lethargic nature was consistent with someone who had been drinking and asked again if he had drinking to which he advised he had not.

Deputy Hill asked Schlossman to exit the vehicle and upon him beginning to walk he appeared unsteady on his feet. Deputy Hill informed Schlossman about the reason for the stop again and elaborated about the BOLO that was provided to him. As Deputy Hill continued to speak with him, Schlossman continued to be unsteady and was seen swaying in place.

Deputy Hill also noted the pungent odor consistent with alcohol followed Schlossman. Deputy Hill asked Schlossman again if he had been drinking to which he stated he had not. Deputy Hill asked Schlossman to submit to Standardized Field Sobriety Testing (SFST) to which he agreed. Deputy Hill confirmed Schlossman did not suffer from resting nystagmus and has not suffered from a traumatic brain injury.

Horizontal Gaze Nystagmus:

Deputy Hill observed Schlossman’s pupils were of even size. Deputy Hill noted Schlossman’s eyes were mildly bloodshot. Schlossman’s eyes were glossy and watery. Deputy Hill explained the instructions to this exercise multiple times and attempted to provide simple demonstrations to Schlossman. However, Schlossman continually failed to grasp the basic instructions placed before him due to his extreme level of intoxication despite Deputy Hill’s best efforts. Deputy Hill attempted to make several passes, and the observations are as follows.

Deputy Hill determined Schlossman’s eyes tracked equally. Schlossman’s eyes lacked smooth pursuit on one pass. However, the following pass, Schlossman failed to follow the stimuli correctly. Deputy Hill noted Schlossman’s eyes exhibited nystagmus prior to the onset of 45 degrees on one pass. However, Schlossman continued to show immense difficulty on focusing on Deputy Hill’s stimuli and would routinely look away from it which was noted by Deputy Hill.

Due to the countless failed attempts to explain the exercise to Schlossman, Deputy Hill determined he was too intoxicated to continue and any further results may be skewed due to him improperly following the stimuli. It should be noted Deputy Hill continued to note a strong odor consistent with an alcoholic beverage emanating from Schlossman during this exercise.

Walk and Turn:

Deputy Hill attempted to place Schlossman into the starting position. Due to there being no safe and readily available straight lines on the side of Interstate 85, Deputy Hill asked Schlossman if he was capable of imagining a straight line the width of his foot. After some explanation, Schlossman advised he understood and was capable of doing so. Deputy Hill then began to place Schlossman into the starting position. Schlossman was instructed to place his left foot on the aforementioned line and then place his right foot in front of his left foot touching heel to toe.

Schlossman was extremely confused by this and stumbled and lost balance when he attempted to do so. This sequence occurred multiple times and Schlossman was never able to successfully do it. Deputy Hill demonstrated the action to Schlossman and attempted to elaborate to prevent any confusion however, Deputy Hill’s attempts were ultimately unsuccessful. At this point Schlossman stopped attempting to enter the starting position and crossed his arms.

After crossing his arms Schlossman insinuated that he felt like he was being picked on or not being put in a position to succeed. Deputy Hill informed him that this was a standardized exercise and all parties suspected of DUI are asked to do it. Deputy Hill asked Schlossman if he wished to continue participating to which he remained silent. Deputy Hill informed him that his silence would be interpreted as no. Schlossman asked Deputy Hill to explain that assumption to him which he did. I Deputy Hill then asked Schlossman again if he wished to continue participating to which he stated no.

It should be noted, during the HGN exercise, Deputy Hill explained to Schlossman that participation in SFST’s was purely voluntary and that it was legal to not wish to participate. Deputy Hill also informed him that failure to participate would force Deputy Hill to only use his observations to that point as the sole basis on determining if he was impaired.

Due to the facts and circumstances stated above, Deputy Hill determined he had probable cause to arrest Schlossman for DUI. Subsequently, Schlossman was placed into handcuffs behind his back while Deputy Hill ensured double locking and proper fitment.

Deputy Hill asked Schlossman if he would provide a preliminary breath test to which he refused. Deputy Hill read Schlossman Implied Consent via an agency issued Implied Consent card where he asked for a blood sample. Schlossman advised he wished to refuse participation.

During field sobriety, Schlossman’s father arrived on scene. He stated his son did not suffer from any physical or developmental disability and was a perfectly normal person. While he was observing his son, he made a comment to Corporal O’Connell that he could tell Schlossman was drunk from where he was standing.

During a search incident to arrest of Schlossman’s vehicle, Corporal O’Connell located one sealed “tall boy” can of Yuengling beer in a black plastic bag lukewarm to the touch. Deputies did not observe any open containers inside of the vehicle. Schlossman’s father agreed to find arrangement to get his son’s vehicle home. Subsequently, towing revives were not required.

Schlossman was transported to the Banks County Jail (160 Windmill Farm Rd, Homer) with charges of DUI Alcohol and Failure to Maintain Lane. Deputy Hill searched the rear prisoner compartment of his patrol vehicle before and after Schlossman occupied it. Subsequently, no contraband was located.

Deputy Hill has successfully attended the standardized field sobriety testing (SFST) and advanced roadside impaired driving enforcement (ABIDE) courses.
