Officer’s Narrative:

On October 10, 2025, I, Deputy Schuster, responded to [REDACTED BY AGENCY] Patchwork Tree Drive in reference to a domestic dispute in progress. An arrest was made and warrants will be obtained.
On scene, I observed two individuals, a male and a female, in the front yard of the residence. The female, later identified as [REDACTED BY AGENCY] was sitting on a circular piece of cement coming out of the ground while the male, later identified at Kevin Pruitt, was standing a few feet behind her.
During the initial call to dispatch, Kevin had advised that he came to pick up his belongings from [REDACTED BY AGENCY] and [REDACTED BY AGENCY] was not allowing him to do so. As I walked up, [REDACTED BY AGENCY] asked me to get Kevin to stay away from her due to him pouring a beer on her.
As I walked up, Kevin pointed to his eye, where I observed his right eye to have a small laceration under it. Due to their close proximity upon my arrival as well as it appearing a physical altercation occurred, I asked Kevin to go stand by his vehicle while keeping [REDACTED BY AGENCY] where she was while I tried to determine what occurred.
As I walked up to [REDACTED BY AGENCY], she advised me she had beer all over her. It did appear that the back of [REDACTED BY AGENCY] shirt, along with her hair, was damp. The closer I got to [REDACTED BY AGENCY] the more I could smell the odor of the alcohol. I asked [REDACTED BY AGENCY] what had occurred and she stated Kevin had come home from work to gather his belongings and asked for [REDACTED BY AGENCY] phone and wedding rings back; which [REDACTED BY AGENCY] denied him.
[REDACTED BY AGENCY] stated she was not denying Kevin access to the residence nor to his belongings as he had advised dispatch. [REDACTED BY AGENCY] stated he currently had belongings in his truck that he had been retrieving from the bedroom. [REDACTED BY AGENCY] advised me that she and Kevin have been married since July 25, 2025 and he has been living at the residence with her since.
[REDACTED BY AGENCY] stated before they got married, they had been good friends for about 28 years. [REDACTED BY AGENCY] stated about 2 days ago, she confronted Kevin in regards to him still messaging his ex-wife on FaceBook. [REDACTED BY AGENCY] stated that since that occurred, Kevin has been nothing but “ugly,” to her and calling her every name in the book. [REDACTED BY AGENCY] advised she just asked Kevin to stop and to leave. [REDACTED BY AGENCY] did stated that Kevin has never gotten physical with her before today’s incident.
I asked [REDACTED BY AGENCY] what had occurred this morning. [REDACTED BY AGENCY] stated at approximately 2:00am this date, Kevin got up to go to work but came home around 8:30am. [REDACTED BY AGENCY] stated Kevin usually works until sometime after 3:00pm and believes he left early to come home and argue with her. [REDACTED BY AGENCY] stated when Kevin got home, he came in and immediately went to the closet in their bedroom to gather some of his things.
[REDACTED BY AGENCY] said that they began to argue and Kevin had began to call her useless and a wh*re. [REDACTED BY AGENCY] said that due to this, she reacted by pushing him slightly. [REDACTED BY AGENCY] stated Kevin never lost his footing or anything but she slightly nudged him in the back.
[REDACTED BY AGENCY] stated when this occurred, Kevin turned around and grabbed her by the throat and pinned her to the ground while standing over her. [REDACTED BY AGENCY] stated, “I couldn’t breathe,” due to Kevin having his hand around her throat and that she was unable to make any sound. [REDACTED BY AGENCY] was unable to recall which hand Kevin had used but stated she couldn’t breathe and was in fear due to it.
[REDACTED BY AGENCY] stated that because of this, she scratched Kevin in the face in an attempt to get him off of her and be able to get up. [REDACTED BY AGENCY] stated Kevin released her and told her he would kill her. [REDACTED BY AGENCY] stated she was able to get up and walk outside and attempted to walk down the driveway to get away from Kevin but he blocked her. [REDACTED BY AGENCY] stated Kevin told her he was going to call law enforcement so she went and sat where she was when I arrived.
[REDACTED BY AGENCY] stated that while waiting for me to arrive, Kevin had come over to where she was sitting and poured a can of Miller Lite all over her. [REDACTED BY AGENCY] also advised me of a prior heart attack she had that caused her to be placed on blood thinners that cause her to bruise easily. [REDACTED BY AGENCY] also stated that during an argument on yesterday’s date, she had attempted to walk down the driveway to distance herself however began having chest pains and was unable to move from where she was.
[REDACTED BY AGENCY] stated Kevin came to her during that and threw her purse at her. I did ask [REDACTED BY AGENCY] if she wanted me to have EMS personnel come check her out and she refused. [REDACTED BY AGENCY] did state that due to the medicine she is on, she does bruise easily and believes her neck with be heavily bruised within the next few days. [REDACTED BY AGENCY] did appear to be struggling to swallow and her voice sounded hoarse.
[REDACTED BY AGENCY] did state that on the incident on yesterday’s date, Kevin’s 13 year old daughter had been home. Kevin’s daughter does live with them at the residence however on today’s date, she was at her older sister’s house. [REDACTED BY AGENCY] advised me that after yesterday, Kevin took his daughter to Wal-Mart to meet his other daughter so she could go stay with her.
I asked Kevin what had occurred. Kevin stated he came to the house to try and get his stuff due to wanting him and his daughter out of the house and when he arrived to do so, she, “pitched a fit,” and would not allow him to have half of his belongings. Kevin stated he and [REDACTED BY AGENCY] got married in July and he had been staying at the residence with [REDACTED BY AGENCY]. Kevin stated on today’s date, he came home from work and [REDACTED BY AGENCY] wouldn’t let him get his stuff. Kevin stated he then called law enforcement. Kevin stated once he called law enforcement, [REDACTED BY AGENCY] started letting him have his belongings.
Other deputies arrived on scene and I advised them of what I had been told so far. I brought Deputy Davis with me back over to [REDACTED BY AGENCY] and had her explain everything to him. While speaking with her this time, I did ask where the incident occurred in the residence and if anything had been damaged. [REDACTED BY AGENCY] stated it was in their bedroom and she did not believe anything had been damaged due to her room being an open floor plan and it not occurring near anything.
I did ask [REDACTED BY AGENCY] if, while Kevin had his hands around her throat, she believed he was going to kill her. [REDACTED BY AGENCY] stated she was scared because she could not breathe. At this time, I did look closer at [REDACTED BY AGENCY] neck and was able to observe red in color marks along the left and right side of her neck.
While looking at her neck, [REDACTED BY AGENCY] apologized to us for not being able to talk right. [REDACTED BY AGENCY] also advised me that she had scratched her elbow while Kevin pushed her in the floor and I did observe her elbow to be slightly discolored and swollen. I also observed a dark in color bruise forming on [REDACTED BY AGENCY] chest.
[REDACTED BY AGENCY] did advise me that she did not want to press charges against Kevin however, I explained the Family Violence Act to her and that, even though she may not want to press charges, the state takes over on that decision, [REDACTED BY AGENCY] expressed her love for Kevin multiple times and that she did not want him to leave, she just wanted him to believe her when she says something. [REDACTED BY AGENCY] stated she did not want Kevin to go to jail however she understood what I had explained to her.
I went to speak with Kevin again to have him readvise his side of the incident. Kevin stated, again, that he had come home to get his belongings. I did ask Kevin if he put his hands on [REDACTED BY AGENCY] in any way and he stated he never laid his hands on [REDACTED BY AGENCY]. Kevin did show me some text messages from [REDACTED BY AGENCY] where she was asking him to get his belongings as well as furthering the situation about his ex-wife.
I did ask Kevin if he poured beer on [REDACTED BY AGENCY] and he stated he did. Kevin stated he poured the beer on [REDACTED BY AGENCY] because he wasn’t going to lay his hands on her. Due to Kevin admitting her poured the beer on [REDACTED BY AGENCY], as well as the physical evidence and observations, I placed Kevin under arrest for Aggravated Assault – FVA and Simple Battery – FVA. I placed Kevin in handcuffs, in the front due to a recent neck surgery, checked for fit and double locked them. I transported Kevin to the Banks County Jail and transferred custody to the on duty jail staff without incident.
I did photograph [REDACTED BY AGENCY] neck and chest and uploaded them to Evidence.com using the Axon Capture App. I also photographed the marks on Kevin’s face and uploaded them as well. I did advise [REDACTED BY AGENCY] of the TPO process. I also reccommended [REDACTED BY AGENCY] to get checked out by a medical professional due to her not being able to breathe during the incident and having trouble with swallowing/talking. I provided [REDACTED BY AGENCY] with a business card with this case number.
Warrants for Aggravated Assault – FVA and Simple Battery – FVA to be obtained and signed by the next on-duty, Magistrate Judge.
