Officer’s Narrative:

On 9/25/2025 Cpl. Burnette was conducting proactive patrols on I85 Sb near mile marker 154. During this time the weather was cloudy and was misting rain. Cpl. Burnette observed a vehicle bearing SC tag [REDACTED BY AGENCY] traveling south on I85 with what appeared to be dark tint in violation of Georgia tint law.

Cpl. Burnette caught up to the vehicle and conducted a traffic stop near mile marker 152. The vehicle did slow and pulled into the emergency lane, but failed to stop. The vehicle then merged back into the right lane before accelerating and initiating a vehicle chase on I85 SB. During this time, Cpl. Burnette observed the vehicle to have a 3rd brake light which was not working, the speeds reached 102 MPH in the rain on I85 before the vehicle exited at the 149 Exit.

The vehicle then began to turn right onto Hwy 441 before making a left turn back towards the entry ramp to I85 SB. The vehicle lost control and began sliding forward, across the yellow marked median/gore area on Hwy 441 and striking 2 vehicles which were stopped at the intersection. The driver then exited through the driver’s window and attempted to flee on foot towards I85 on ramp.

Cpl. Burnette gave chase and deployed 1 taser shot into the suspect gaining NMI (neuromuscular incapacitation). Cpl. Burnette used his left hand to gain control of the suspect while giving verbal commands. The suspect refused to obey commands and then got up off the ground. Cpl. Burnette deployed another taser shot which was ineffective due to small probe spread.

The suspect then attempted to grab Cpl. Burnette’s taser which was in Cpl. Burnette’s right hand. Cpl. Burnette created distance and holstered the taser. The suspect then attempted to flee again. This time, K9 Bruce was deployed to apprehend the suspect, but was unsuccessful. Cpl. Burnette caught up to the suspect running in the parking lot of Starbucks. Cpl. Burnette pushed the suspect forward which caused him to fall in the grass island area.

Once on the ground, Cpl. Burnette attempted again to gain control of the suspect. During this time, the suspect grabbed Cpl. Burnette’s vest, ripping his camera off and onto the ground, the K9 mobile alarm system off Cpl. Burnette’s vest, and hit Cpl. Burnette’s hand away from his radio as he attempted to call out to dispatch to request help.

During this altercation, Cpl. Burnette did use hard hand techniques to the face of the suspect. The suspect then attempted to buck Cpl. Burnette off his back where he had positive control of the suspect. During this time, Cpl. Burnette locked his feet around the suspect and his arms around the upper torso area maintaining positive control of the suspect. Cpl. Burnette held the suspect until Cpl. Langston arrived on scene and the suspect was taken into custody. All force was stopped once in handcuffs.

Cpl. Burnette conducted a search of the suspect and pulled out a large amount of currency, baggies, rolling papers, and he smelled strongly of marijuana. Cpl. Burnette called to have EMS tend to the laceration of the suspect’s head/face. K9 Bruce was placed back inside the patrol car and the individuals that were hit by the suspect vehicle were told to wait in their car until deputies could get to them. GSP was enroute to the accident and assisted with the vehicles and occupants from the 1st accident.

Cpl. Burnette relocated to the 2nd scene of the fleeing vehicle. There was a passenger inside the suspect vehicle who attempted to flee in the vehicle North on Hwy 441 but didn’t make it far from the original scene before crashing into a DOT road sign at the intersection of Hwy 441/Eisenhower Dr/Amoco parking lot. Once the vehicle wrecked the occupant fled on foot as well after the second accident.

Deputies could smell a strong odor of marijuana coming from the vehicle. A probable cause search based on plain smell was conducted. During the search of the vehicle a metal tray with marijuana residue and a THC vape was located inside the vehicle by deputies, a tin can with suspected THC wax was in the driver door area, and in the trunk was a black trash bag with approximately 8 bundles of marijuana they had a total approximate weight of 9.1 pounds. Also located was a small bag of marijuana, scales, and both small and large baggies consistent with the distribution/sale of illegal narcotics. Inside the passenger compartment there was bullet casing, but no gun was recovered at the time.

During this time, deputies were getting different reports of possible suspects but could not confirm if they were involved with the incident. At this time, Cpl. Burnette observed a male walking up to the crime scene, recording. The male did speak to deputies and Cpl. Burnette did engage in conversation with the male. The male was asked respectfully by Cpl. Burnette to back up due to the crime scene. The male refused to back up and began debating about the legality of where he was recording from.

At this time, Cpl. Burnette was attempting to ensure scene security for GSP to conduct their investigation and to ensure no one was tampering with anything within the scene area all while deputies were attempting to direct resources, finish searching the vehicle, and ensuring officer safety. Cpl. Burnette informed the male he did not want him that close to the scene.

This incident had 3 different scenes, with the last scene being this one. Rarely do deputies have to put yellow tape up to create a barrier for scenes, especially ones that have 3 separate scenes expanding across 6 lanes of travel. Deputies commonly advise citizens to stay at a certain distance that is reasonable with no issues. This incident was not like a normal incident. This incident had 2 taser deployments, a physical altercation between deputies and one suspect, a suspect who fled the scene possibly armed with a firearm, and a large amount of narcotics being located.

This scene was also tense, uncertain and rapidly evolving. It also should be noted that suspects do attempt to get back to the incident to retrieve certain things. With the amount of narcotics and the first suspect fighting deputies, Cpl. Burnette believed that keeping the scene secure and not allowing people to get to close was reasonable and that his request to the male to no get any closer was reasonable based on the totality of circumstances. At no point did Cpl. Burnette advise the male he could not record; he was just asked to do it further back than he wanted to. Cpl. Burnette also never made physical contact with the male recording either.

GSP arrived and conducted the crash investigation. The suspect/driver was identified as Kevin William/Williams. William came back with multiple warrants out of different states. William also has a lot of aliases with different dates of birth and socials. Cpl. Burnette took all charges relating to the crash and incident. The charges were signed by a magistrate judge. Vehicle was towed by next list.

All evidence was placed into evidence lockers for processing. The cash was seized along with the phones. The cash has a value of $2,690. There were also 1 liter drink bottles which were taped up and filled with tobacco, lighters, white t shirt, rolling papers, earbuds, and a knife. This is a common trend seen by people attempting to smuggle contraband into prisons or jails. There was a note written inside one of the bottles as well. The window tint was tested and read at 15 percent which is a violation of Georgia Law.
