Officer’s Narrative:

[NARRATIVE #1]
On Wednesday, 12/15/2021, at approximately 0850 hrs, I responded “code 1” (non-emergency) to a welfare check at the Chevron gas station located at 703 Kilcrease Rd in Auburn GA. Dispatchers advised that the caller observed a white female walk from her car at the fuel pumps, stumble across the parking lot. The caller stated that the white female was stumbling in the store and bumping into the displays before checking out and going back to her car. The caller told dispatchers that the white female was sitting in a silver Kia Sorento at the fuel pumps.
Upon arrival, I observed a silver Kia Sorento (GA [REDACTED]), parked at the fuel pumps with a white female in the driver’s seat. I exited my patrol car and approached the vehicle. I observed the female looking down, not aware of my presence or aware that my patrol car was parked in front of hers. I knocked on the driver’s window to get the female’s attention. The female opened the driver’s door and stared at me with a blank stare. I identified the female as Abigayle Towns. I explained to Abigayle that someone saw her stumbling in the parking lot and that that person wanted to make sure she was ok. I asked Abigayle to exit the vehicle. Abigayle did as I asked. Abigayle told me that she was coming from Lawrenceville GA and was waiting for her boyfriend, Robbie, to arrive. Abigayle stated that Robbie drives a white Chevy truck. Abigayle told me that the reason why she was acting the way she was is because she had been up for approximately 3 days due to her father being in the hospital. Abigayle said that her father had a heart attack, and he was air flighted from Monroe GA to St. Mary’s Hospital in Athens GA. As Abigayle was speaking, I noticed that her speech was slow, slightly slurred and her voice was very low.
While I was speaking to Abigayle, I observed damage to her vehicle on the front end and her driver’s side mirror was missing. I also noticed that all 4 tires had marks on them consistent with driving into curbs. I asked Abigayle what happened to the vehicle. Abigayle stated that she hit a deer a few months ago and that as she was driving to the gas station, she hit a construction cone. While Abigayle was speaking to me, she stated that she drove from Lawrenceville to the gas station. As I was speaking to Abigayle, I noticed that she lost her balance and began to fall over. I stopped Abigayle from falling over and assisted her in standing up. I asked Abigayle if she ingested or consumed anything that would impair her ability to drive or would cause her to stumble as she walked. Abigayle stated that she did not ingest or consume anything. Abigayle was asked if she would like to do Standard Field Sobriety Evaluations to make sure she was ok to drive. Abigayle agreed to do field sobriety evaluations and Deputy Cruz #175 conducted the evaluations.
Deputy Cruz advised me that based on his field sobriety evaluations and investigation, Abigayle was operating a motor vehicle under the influence of drugs. Abigayle was placed under arrest for driving under the influence of drugs. Before placing Abigayle in handcuffs, she was given multiple opportunities to contact someone to pick up her vehicle. Abigayle tried to call her boyfriend Robbie, but he did not pick up her phone. Abigayle was placed in handcuffs, checked for fit, and double locked. Abigayle requested that I get her purse from her vehicle so that it could go to the jail with her. Abigayle was searched incident to arrest and placed in Deputy Cruz’s patrol car. I asked Abigayle if she wanted the pink backpack to go with her and she stated no.
Abigayle’s purse was located on the front passenger seat near a pink backpack. I brought the purse over to Deputy Cruz’s patrol car. I looked down and in plain view, I observed a small red bag with residue inside it, blue rectangular pills and packets wrapped up with a rubber band. Upon further inspection of the items located in Abigayle’s purse, I retrieved 2 red bags with a small amount of a white powdery substance suspected to be cocaine. The blue rectangular pills had B707 stamped on them, and I identified the pills as [REDACTED BY AGENCY], a schedule 4 controlled substance. I field-tested the white powdery substance suspected to be cocaine. The field test showed a positive indication for cocaine. I established probable cause to search the purse due to the fact that I observed the red bags with a powdery substance identified as cocaine and the [REDACTED BY AGENCY] pills. Inside the purse, I located 3 green bags, and 2 clear bags with white powdery residue inside the bags, suspected to be cocaine. I identified the packets wrapped with a rubber band as [REDACTED BY AGENCY], a schedule 3 controlled substance. Abigayle had 25 unopened packets and 1 opened packet of [REDACTED BY AGENCY].
Due to Abigayle not being able to have someone pick her vehicle up, the vehicle was towed. Prior to towing the vehicle, an inventory search was completed of the vehicle. Inside Abigayle’s vehicle, I located a pink backpack. Inside the pick backpack, multiple narcotics were located. I located more pills inside of a white unlabeled bottle. The pills were stamped with B707 and identified as [REDACTED BY AGENCY], a schedule 4 controlled substance. In total there were 128 pills of [REDACTED BY AGENCY] counted (including the [REDACTED BY AGENCY] pills located in the purse). I located a clear plastic bag containing blue circular pills stamped with M and 30. I identified these pills as [REDACTED BY AGENCY] a schedule 2 controlled substance. In total, I counted 40 [REDACTED BY AGENCY] pills. I located a large clear bag filled with small red bags, a scale, three straws with residue inside them, and a small clear bag with a white powdery substance containing suspected cocaine. I located 2 crystalized rock substances which weighed 2.05g and 3.15g, and a light brown/tan substance – these substances remain unknown. I located 3 purple pyramids wrapped up in foil. I also located instructions on how to use “carfent”, and one of the bags which had light brown/tan substance residue had written on it instructions. A clear bag with light brown/tan substance had written on it “please be careful”.
In the cargo area of the vehicle, I located a black bag. Inside the black bag, I located 6 plastic containers. Each container had a light brown wax substance which field-tested positive for high concentrate THC. Each container had a flavor written on it, and some had a weight in grams written on them. I located a hydra bong, some wax papers, and empty pill capsules.
While I was waiting for a narcotics investigator to arrive on the scene, I saw a white Chevy Silverado (GA [REDACTED]) drive into the gas station operated by a white male. The male exited the vehicle, me and Deputy Cruz approached him and asked him if his name was Robbie. The male identified himself as Robbie and stated that his girlfriend was Abigayle, and he was coming to check on her. I noticed that Robbie’s speech was low and slow. I observed a white powdery residue under Robbie’s nose. I told Robbie to look up so that I could see into his nostrils. Inside Robbie’s nostrils, I observed a white powdery substance stuck inside his nostrils. I told Robbie of my findings and detained him. I placed him in handcuffs, checked for fit and double lock. Robbie had his wallet in his hand when I placed him in handcuffs. I identified Robbie as Robert Humphrey. I searched Robert before placing him inside my patrol car. Inside Robbie’s right front pocket I located a blue straw with residue inside it. Inside Robert’s wallet, I located a light brown/tan powdery substance (1.03 g), 1 red bag containing a white powdery substance suspected to be cocaine, and 2- $2000 bands (no money just the bands). Robert admitted to the narcotics investigator that arrived on the scene that he consumed cocaine and that he had cocaine in the center area of his vehicle.
Robert was placed under arrest for the possession of cocaine. Robert stated that he was not able to have anyone pick up the vehicle. Robert was told that his vehicle would be towed due to the fact that he could not have anyone pick up the vehicle. An inventory search was completed on Robert’s truck. Inside the center counsel, I located a small red plastic bag that contained a white powdery substance suspected to be cocaine.
Both vehicles were removed by Hammonds Towing. Abigayle and Robert were transported to the Barrow County Jail without incident by Deputy Cruz. Deputy Cruz advised me that while at the jail, he located in Abigayle’s purse, in a hidden area, inside an unmarked white bottle, 2 pills marked with ELI-515. I identified those pills [REDACTED BY AGENCY] and [REDACTED BY AGENCY], a schedule 2 controlled substance. Deputy Cruz transferred custody of Abigayle and Robert to the deputies on duty. Deputy Cruz checked his back seat before and after transporting the suspects and he did not locate any contraband.
I established probable cause to charge Abigayle with the following charges
Abigayle was charged with driving under the influence of drugs less safe based on Deputy Cruz’s investigation in violation of OCGA 40-6-391A2 DUI less safe drugs
Due to the fact that Abigayle had 2 small red bags containing a white powdery substance identified as cocaine in her purse, Abigayle was charged with OCGA 16-13-30a – possession of cocaine
Due to the fact that Abigayle had approximately 2g of cocaine contained in multiple bags in her backpack, she was charged with OCGA 16-13-30a possession of cocaine
Due to the fact that Abigayle had 128 pills of [REDACTED BY AGENCY], a schedule 4 controlled substance, inside her backpack and purse, she was charged with OCGA 16-13-30a – Sch 4
Due to the fact that Abigayle had 128 pills of [REDACTED BY AGENCY], a schedule 4 controlled substance, small red bags, and based on my knowledge and experience in dealing with narcotics, I know that this is not a user amount of pills, she was charged with OCGA 16-13-30b possession of a schedule 4 controlled substance with intent to distribute
Due to the fact that Abigayle had the 128 pills of [REDACTED BY AGENCY] in an unmarked white bottle, she was charged with OCGA 16-13-75 drugs to be kept in the original container.
Due to the fact that Abigayle had 40 [REDACTED BY AGENCY] pills, a schedule 2 controlled substance, in a plastic bag inside her backpack, she was charged with OCGA 16-13-30a Sch 2 possession of a schedule 2 controlled substance.
Due to the fact that Abigayle had 40 [REDACTED BY AGENCY] pills, a schedule 2 controlled substance, small red bags, and based on my knowledge and experience in dealing with narcotics, I know this is not a user amount of pills, she was charged with OCGA 16-13-30b-F possession of a schedule 2 controlled substance with intent to distribute
Due to the fact that Abigayle had 40 [REDACTED BY AGENCY] pills inside a plastic bag, she was charged with OCGA 16-13-75 drugs to be kept in the original container

Due to the fact that Abigayle had 2 pills of [REDACTED BY AGENCY] and [REDACTED BY AGENCY] in her purse, a schedule 2 controlled substance, she was charged with OCGA 16-13-30a Sch 2 possession of a schedule 2 controlled substance
Due to the fact that Abigayle had 2 pills of [REDACTED BY AGENCY] and [REDACTED BY AGENCY] a schedule 2 controlled substance, in a white plastic unmarked bottle, she was charged with OCGA 16-13-75 drugs to be kept in the original container
Due to the fact that Abigayle had 6 containers containing a light brown wax substance, which was identified as high concentrate THC wax, she was charged with OCGA 16-13-30 a possession of a schedule 1 controlled substance
Due to the fact that Abigayle had three bags containing approximately .9g, 1.9g, and .35g of a light brown substance which tested positive for heroin, she was charged with OCGA 16-13-30a possession of a schedule 1 controlled substance.
Due to the fact that Abigayle had 3 bags containing approximately .9g, 1.8g, and .35g of a light brown substance identified as heroin, and small red bags, and a scale, she was charged with OCGA 16-13-30b-F possession of a schedule 1 controlled substance with the intent to distribute
Due to the fact that Abigayle did possess a hydro bong, 4 red straws with residue inside them, small red bags, 3 metal objects used for the THC wax, and a scale, she was charged with OCGA 16-13-32.2 possession of drug-related objects
Due to the fact that Robert had a blue straw with residue inside it, in his front right pocket, he was charged with OCGA 16-13-32.2 possession of drug-related objects
Due to the fact that Robert was seen driving a motor vehicle, had white powdery residue under and inside his nose, and that he admitted to using cocaine before driving he was charged with OCGA 40-6-391A2 driving under the influence of drugs less safe
Due to the fact that Robert had a small red bag in his wallet and a small red bag in the center counsel of his truck, he was charged with OCGA 16-13-30a possession of cocaine
All narcotics were tested and placed into evidence at the Barrow County Sheriff’s Office. The narcotics that were not identifiable were submitted into evidence and charges will be taken out once the substances are identified. All straws containing residue, the hydra bong, and the scale were destroyed. All pills were identified using drugs.com/pill identifier. The original caller’s information was not obtained.

[NARRATIVE #2]
On December 15, 2021, at approximately 0923 hours, I responded code 1 to 703 Kilcrease Rd (CHEVRON-AUBURN) to assist Deputy Breazzano on a welfare check.
Upon arrival, I met with Deputy Breazzano who stated that Abigayle Towns the driver of a silver Kia Sorento bearing Georgia registration number [REDACTED] was possibly under the influence. I began talking with her and observed both of her eyes were droopy, her speech was slurred, and she could not keep her balance. I asked her if she would mind performing field sobriety to make sure she was okay to drive any further. She stated that she would.
I had her sit on the push bumper and asked if she wore glasses or contacts, to which she replied no. I asked if she had any medical issues that would prohibit her from walking and turning or standing on one leg, to which she replied no. I checked for equal pupil size, resting nystagmus, and equal tracking. I checked for lack of smooth pursuit, which I observed two clues. I checked for distinct and sustained nystagmus at maximum deviation, which I observed two clues. I checked for onset of nystagmus prior to forty-five degrees, which I observed two clues. I then checked for vertical nystagmus, which was not observed.
I instructed her to stand away from the vehicles and to imagine a straight line going out in front of her and to place her left foot on the line and then place her right heel to her left toe. Before I could complete my instructions she started walking. She did this multiple times. When I finally got her to stay in the position as instructed she could not keep her balance long enough for me to complete my instructions so this evaluation was not completed.
I instructed her to stand with her feet together and her hands down by her side until told otherwise. I instructed her to pick up one foot of her choosing and to hold it about six inches off the ground and to count out loud 1001, 1002, 1003, and so on until told to stop. I demonstrated this to her. During this evaluation, I observed the following clues puts foot down, uses arms to balance, and sways.
I placed Abigayle under arrest for driving while under the influence of drugs. I placed her in double-locked handcuffs with her hands behind her back and checked for proper fit. She was searched for contraband, but none was located. She was placed in the backseat of my patrol vehicle. I read Georgia implied consent notice for suspects age twenty-one and over and requested a sample of her blood, which she refused. She asked if she could have her cellphone which was located in her purse which was in her vehicle. Deputy Breazzano retrieved her cellphone, but he located in plain view a suspected illegal substance.
Deputy Breazzano and I began a probable cause search of her vehicle. Deputies located a pink and brown Jansport backpack in the front passenger floorboard containing large amounts of very small plastic bags and multiple unidentified substances. After a complete search was done on the vehicle numerous illegal items were located inside the vehicle.
I transported Abigayle Towns and Robert Humphrey who was also arrested by Deputy Breazzano to the Barrow County Detention Center. Upon arrival, both individuals were turned over to the deputies on shift. Before and after transport the backseat of my patrol vehicle was searched for contraband.
